We still haven't been approved our EAD but I wanted to know if my hubby could work as soon as he gets the approval e-mail? If so, what does he tell his employer if they ask how that can be?

I think you can yes as long as he shows his card within 3 months of the first day of work. He needs to be legally able to work at the date he gets hired though.

Here's the quote from the I-9:

Employers must complete Section 2 by examining evidence of identity and employment eligibility within three (3) business days of the date employment begins. If employees are authorized to work, but are unable to present the required document(s) within three business days, they must present a receipt for the application of the document(s) within three business days and the actual document(s) within ninety (90) days.

I would show the employer your receipt for the I-765 and the approval email and show the the original card when it arrives.

Here's the quote from the I-9:

I would show the employer your receipt for the I-765 and the approval email and show the the original card when it arrives.

Okay thanks guys. I was asking because that's what I thought but hubby was like well how about if they think they will get in trouble and want to wait for card. I told him I would ask. :)

The only way they would only get in trouble if they were raided by ICE anyway, which is pretty unlikely to happen. Not that they would get in trouble because hiring someone with approved EA is perfectly legal.

Sorry to be rude, but you really have not been waiting long enough to have "your patience running out". When you pass 90 days of waiting and are beyond the 'normal processing time', I could understand it then. You card was ordered on day 68, you have been given plenty of great advice. Relax.

Hope you don't get stuck in name check, then you will really have your patience tested.

I'm sorry John and Annie........ I know the waiting is hard. I've been there and I'm still here. I can't even go home to see my children. Maybe I'll get to see my eldest son sometime soon. It will be 3 years next February since I've seen him.

Here's hoping you get your FBI checks completed very soon.

Everyone has different tolerance levels, thus although 68 days may seem short to you, it seemed very long to me. :mellow: And having read a lot of posts on here I do know that people have been waiting a long time to get the papers processed. I can empathize with a lot of people on VJ. Going through this process is no easy task reagardless of how long or short you have to wait.

you are right, this is not an easy process.

I guess my main point is that regardless of the few that get there documents early, they have 'normal' processing times on the forms and if you get it early, great.

But this is government work, they look at everything by the ultimate due date, not like a normal workforce.

We think we are out of the check(9 months 22 days), we received an RFE for the Medical. What will be interesting is to see if we will receive the 10 year as that we will have passed our two year Anniversary by the time they get the medical back.

We hope you get ot see your kids soon.

OMG yes I agree. Some are lucky to get approved super fast and then others just have to sit and wait. Its 86 days today for our EAD and nothing. Others who filed after me already have the card in hand. Like it was said...this is immigration what can we expect.
