Married for three years, deeply in love, we didn't rush to file for almost a year. We tied the knot in the U.S. while he was visiting his sister and decided he would stay. As the petitioner (female), there's a 23-year age gap between us. We have all documents jointly. While our interview approaches, my general anxiety kicks in, especially as I notice concerns raised about our age difference. However, we share the same religion, culture, and language, both originating from the Middle East.

 

While age holds no significance in our relationship, we understand USCIS may scrutinize our age gap, adding to our nerves. Hearing unsettling anecdotes about these interviews fuels our worries, despite the genuineness of our marriage. I'm reaching out to find others who've navigated a similar situation, particularly with an older female (petitioner) and younger male, to gather insights on what to anticipate during the initial interview.
 

Fortunately, we've retained an outstanding, albeit pricey, attorney who will accompany us to the interview here in the U.S.

He came  3 years ago on tourist visa and u married but did not adjust so he's been out of status all this time?

 

Age difference will not be the issue here as he and u have lived together in the US with proofs

Hope he has not worked!

How did u file IRS as he was illegal?

 

Attorney at interview can not answer any questions 

 

  • It is expected that attorneys will provide their clients with relevant legal advice prior to, rather than at, the appointment interview, and will advise their clients prior to the appointment interview that the client will participate in the appointment interview with minimal assistance.
  • Attorneys may not engage in any form of legal argumentation during the appointment interview and before the consular officer.

Yes, your situation will raise some questions for the interviewing officer.  Try to not take it personally. Even if  the “red flags” are not real in your case, the IO will  approach approval with caution and  this will require robust questioning. 
Be well prepared, well documented, answer simply and honestly, don't offer what isn't asked for, stay calm and respectful.

He last came in 2022 on a visitors visa. He’s had one for multiple years. We got married in 2022, we delayed filing the papers cause he wanted me to move back with him to our home country since he has land and wanted to be a provider for me. We figured everything out and we had the attorney file everything in 2023. Later in 2023, he got his EAD, SSN, and Advance Parole. 2023 taxes were done for 2022 without his social. 2023 taxes done this year with his social cause he had one. Both years are joint married. He never worked here. Our interview for 485 & 130 is coming up.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I honestly do not think you have to worry about anything if your marriage is legit and you have lived accordingly.  My age difference of 40 years, me older, was never an issue in the process.  Good luck.

You will be fine, no worries,   We had numberous Red flags, age was one of them,  and finally he is taking the Citizen oath next week.

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 5 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response per NOID,   Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

As long as you can show that you have a genuine relationship, you shouldn't have a problem with the age gap. I'm 14 years older than my husband. We were able to prove a genuine relationship and it was pretty smooth. The only other advice I can give is, under no circumstances, tell anything other than the truth. Some interviewers may try to trip you up.
