Needing help Regarding the I-134 Can the main fiancial sponsor be someone different than me? [merged threads]

Timeline

I work a part time job (which is under the poverty line) and do free lance for the rest of my work, I would like to use a family member as the sponsor.

 

Can I use them as the main sponsor, or do I have to file them as a "Co-Sponsor" still? Can I fill out all of Part 3 with their information? Will their W2 be Sufficient or is a statement from their employer a must?

Are you petitioning a fiancé?  You are the sponsor.  You may be able to use an eligible joint sponsor.  The I134/I865 with all supporting documentation (Tax transcripts, payslips, employer letters etc) will be required from both you and the joint sponsor.

 

You may want to look at getting a better job, or a second job even.  Bringing over someone who won't be eligible to work for upwards of 8 months is impractical on poverty line wages.  You will also need to look into providing health insurance for that person.

If I were to get a new job say later this week what evidence would I include since I wouldn't have a W2 yet? Just the first pay stub?

Trying to understand, if I don't meet poverty lines alone I can use a Co-Sponsor, does that mean I need to send in an I-134 filled out in my name and also an I-134 filled out in their (with supporting evidence?) If I'm not meeting the requirements at all do I just use them as the main Sponsor on it since it doesn't have to be the petitioner?

Pay stubs are good evidence of current income.

Both if neither of you meet the requirements and you are combining your incomes to meet the limit. But I assume you only need one person to do so. But if that one person doesn't pass the income requirements by a good margin, I'll file both to make it look better.

This is incorrect.  You cannot combine incomes with a joint sponsor.

 

And your “assumption” is also incorrect.   I know you’re just trying to be helpful, but you are actually dispensing wrong information here.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, you will need two I134s and supporting documents for both.  You as the petitioner are always considered the main or primary sponsor even if you make zero dollars, and anyone else would be considered a co-sponsor.

Yes, an I-134 from you and another from the co-sponsor.  A pay stub is evidence of current income for an employed person.  W2s are about te past.

Facts are cheap...knowing how to use them is precious...
