So here's the situation. I am a Canadian, my wife is Mexican. She is with me in Canada under PR. I am able to get a green card through work without too many issues, however, my wife had previously overstayed for over one year in the US and as such is facing her ten year ban. We have a kid on the way. I would love to get out of Canada, but I see no point in pursuing a green card unless I can extend it to my wife and child. Considering the ban my wife is facing, I'm not sure whether or not this is even feasible and I was hoping to get some advice on how to proceed, if at all. Thank you all in advance.

Needs a qualifying relative to file a waiver and that would not be you until you got your GC. Now I am not sure if say both of you went to the interview, you were approved she was not, you enter and get your I 551 stamp can you then file a waiver based on the Employer filing?

I 601 take bout 2 years anyway and if you have to sponsor her and then file a waiver more like 6. Putting together a waiver could also be interesting when you just got there.
