CR1 expires

Good evening all, 

 

I am still waiting for CR1 visa which is in AP. My medical exam expires beginning of August (I believe this is when the visa expires too). I’m worried that if the Visa is issued mid July I will run of time to enter the U.S. as I need to give my work one month notice, organise shipping etc. 

 

Has anyone experienced such a tight window ?

What should/do I do if I have less than a month before visa expires? As I have to give my work 1 month notice. Currently I cant hand in my notice as I am still waiting for the visa to be issued.

 

Wondering if anyone experienced this.

I just found on here that someone on VJ has been through this and she chose (with success) to “Enter the US before the expiry date to validate the VISA” as opposed to “Let the visa expire and make a written request to the Embassy for a new visa (and a new medical exam)”

Once you enter you are a LPR. You have the I 551 stamp.

 

Now going back and working out your notice could be expensive and the tax issues would be a pain.

I was on the same boat.

Did my medical on Oct 24, 2023. Interviewed on Nov 16. On AP until Feb 8 (longest 3 months in my life). Visa was only valid until Apr 24 (6 months after medical). That means I only had 2 months to enter the US before the Visa would expire. Praxis at my work is 3-month notice before termination.

Talk to your boss. Explain and warn about the situation. What your boss concerns most is to find your replacement. I already told my boss about this possible scenario when I was called to the interview at the Embassy. No problem at all and I helped them find and even train my replacement. Ended up costing me some saved-up vacation days only.

Not worth it to fly in and out of the States.

If it were me, I think I'd prefer to fly in & out of the US, wrap up your things in the UK, and then return to the US fully. I don't think I'd take my chances with the additional processing & new medical! It takes a few weeks to receive your SSN & a few months to get your physical green card anyway.

 

That said, I'm sure your preference will be to leave the job sooner. Perhaps you can use some vacation days.
