It is a very common mistake to use the words "they should" as synonomous with "I want".

You paid a fee for the USCIS to process a petition. If denied, they processed your petition. They did what you paid the fee for.

Why should they refund the money? You paid for a service: for them to process your petition, the result was not what you expected but they did process your petition, the service is given. There is no reason to get your money back.

I don't think you should expect a refund. They processed your petition, just because it got denied doesn't mean they didn't do their job.

it was a fee for a process. no the money should not be refunded. its like asking for a refund on college if you fail. you used the services therefore you dont get a refund.

No.Unfortunately they keep all of your money.They claim they use this for processing fees.

if you download I129F instruction PDF page from USCIS. The first paragraph ends with this ....

If you do not have internet access, call theNational Customer Service Center at 1-800-375-5283 to verify the current filing address and edition date. Improperly filed formswill be rejected, and the fee returned, with instructions to resubmit the entire filing using the current form instructions.

but again getting denied versus forms rejected, could be different ..

I would like to know actually how long it takes to adjudicate a case, on average, by hours. Know there's probably some huge variations there but yeh...especially with the big fee increase for the petition, and not much in materials we're using up I don't reckon, about how much $$$ per hour is this coming out to?
