2nd K1 petition for beneficiary

I need some answers,my ex filled k1 and we got approved April 2023.

However,by the time we were approved we have already broken up in April 2022 and the relationship couldn't be fixed. Case was already sent to Embassy,I contacted embassy to withdraw they asked for the ex signature on the letter. He signed I sent it back and the case was sent back to nvc in Feb 2024.

I met someone else and things are great. My question is if they were to petition for me what are the chances of approval at the embassy level. Do they have to indicate that I was petitioned for before or does this apply only to the petitioner if they are multiple filer. Since I never went to the interview and the letter I sent was very detailed.

I appreciate any advice TIA

Not on the I-129f but when you fill out the DS-160, there is a question “has anyone ever filed an immigrant petition on your behalf” and you’ll have to mark Yes.

Depends on what consulate it is and if you have good evidence of a genuine relationship (a lot of visits/in person time).

Thank you for your response The yes part will be for this current petition right?

We have lots of evidence and it's a genuine relationship. Even the past one was it's just things didn't work out.

Why? I-129F is not an immigrant visa petition. It is not I-130.

K1 is a non immigrant visa but treated as an immigrant visa at every step and is processed only by the immigrant visa unit. I see I-129f as an immigrant petition.

In any case, the consulate will be aware of any past petitions filed for the beneficiary.
