I understand the part where she can select general, but she had everything prepared as if she selected spouse of U.S. citizen option, question is will it hurt? She is shipping the application within a day or so.

 

When you look at the processing times for N-400 on the USCIS website, it says that it's for applicants under the general provision, and that cases under the 3-year rule (spouse of US citizen) may take longer. No idea if it's true in practice. Other potential downside is that you may be required to go to her interview if she chooses that option. If I were her I would select the general provision and still send key elements of the evidence she had prepared (like I said earlier house title, kids birth certificate, tax transcripts...). No need to open the door to more questioning.

If you're in a hotel lobby and trying to get to your room on the 20th floor... Would you take elevator (5 year rule) or would you climb the stairs (3 year rule)? Why do you want to make the interview potentially harder than it is? Your wife won't get any special reward going harder route. The end result is the same - citizenship. I just don't understand the question...

Proof of my 1st marriage Termination
Proof of Wife's 1st Marriage Termination
Wife's Green Card
Our Marriage Certificate

If she's eligible to file under the 5-year rule, I would go for that. 

I filed under the 3-year (marriage) rule. I had more evidence that it's asked for. However, in my N-400 interview, the Officer still asked many many questions here and there. It made me nervous because the Officer had a strong accent. You don't want to put your wife in that stressful situation during the interview.

Marriage Certificate

If either was divorce prevously, take Divorce decree

My birth Certificate

Copy of ongoing checking account 2016-2024

Green Card.

What is the date on her GC stating Resident Since: ??? 

That's the important thing to validate which way to file it. Under 3 years or 5 years rule.

That's a very good point. Frankly speaking, all the other prior petitions other than I-130 and I-864 was also hers Especially I-751. But now it's 200% her responsibility to answer everything correctly and go through the process.

Makes sense. Ok, so she became a resident June 16, 2019. Does she need to wait until then to do the general 5 year option? Or can we do it early now?

She said she will go with the general option after everyone explanation. She was resident June 16, 2019. Does she need to wait until June 2024 or can she do it now?

90 day early filing works for both 3 and 5 year rule. If she didn't break continuous residence and meet physical presence requirements, she can file today.
