Getting a tourist Visa to a third country while waiting for a K1

I am just getting ready to start my K1 Application. and I am in research mode. 

 

I met my Fiancée in the Philippines a couple of weeks ago. And we are taking about meeting up in Denmark, since I have family that have already been planning a trip there and can go along. We are thinking that might be easier than the US.  We have been told by multiple people that once you have a boy friend or Fiancé, it is pretty much impossible to get a tourist visa to the US, from the Philippines. 

 

Anyway we are looking into what is called a Schegen Visa to Denmark. My question is how would officials view this? If I apply for the Fiancée visa first, would that send any red flags? 

 

I also know that they want people to be honest.  But my Fiancee is worried because she tried to get a tourist visa to the US before when she was trying to visit her a different Boyfriend and was turned down. Should she disclose who she is going to visit?

I have a hard time getting time off from work, and have other commitments at home as well. I just got back from the Philippines and don't forsee another trip there until January. Or maybe September if Denmark doesn't work out. 

 

When I was looking into marriage in the Philippines, it said you should plan on at least two weeks. Which would be difficult for me. 

 

So as people have said the spousal visa is faster and cheaper, but I can get the K1 started now.

Not sure what a K1 has to do with a Schengen, what is the connection?

I don't think the Danish or any other EEA government would care if you were applying for a US visa.  However, to gain a Schengen visa your fiancée have to confirm how the trip was being funded and that she had medical insurance in place.

The more I think about it, I think that they are not very related. The Danes are going to have different criteria than the US. There is a lot of posts I found about visiting each other on a visitor visa in their current country. But I hadn't found one about meeting somewhere else. Maybe because it doesn't really matter.

This sounds fun! No, there will be no problems from that standpoint. These are two different governments and no issues. The only red flag involved here would be the Danish flag. :)

 

Your initial post indicates you met your fiancée a couple of weeks ago. Perhaps it is an issue of wording, so I presume you mean that was your first in-person meeting and and that you have known each other for a while prior to the first meeting. From the K-1 standpoint, it may be challenging to prove the authenticity of the relationship in general if you file for the visa so soon after first contact. Again, I hope it was a simple misunderstanding on my part. Good luck!

Going slightly off topic I investigated getting married in a third country before going down the K-1 fiance visa route. In terms of the bureaucracy, cost and visas Denmark came out very well.

The Manila embassy hands out K-1 visas like candy.  Nobody will care if you want to travel to a third country.  In fact, the additional time together in person solidifies the nature of your bona fide relationship.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It won't affect the K1 at all.  We submitted evidence highlighting our trip to Europe, including the visa and matching passport stamps, as relationship evidence with our spousal petition.

 

Your fiancées previous B2 denial won't affect the K1 either.  She must declare it honestly on the DS160 but they won't ask questions about it and if anyone did ask, she was "denied due to insufficient ties to her home countries".  That's the same reason everyone is denied B2 visas.  They gave her a slip of paper that said so.  No need to elaborate further.

 

Just a note on the Schengen visa.  Denmark has the second to highest denial rate for Schengen visa applications in the Philippines.  The only Schengen country with a higher denial rate for Filipino passports is Finland.  Before we were married my wife applied twice for Schengen visas.  She was denied by France so we went embassy shopping and after some research discovered the Netherlands is traditionally the most generous with Schengen visas in the Philippines. She was approved by the Netherlands a few months after the France denial.   Also, be aware that the Schengen visa process is a fairly arduous, paperwork intensive effort for Filipino passports.  It can be done.  We did it.  But Schengen visas are not easy with a Filipino passport.

  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

Denmark has certainly become more hard line with regard to immigration over the last few years.

 

I think the main problem will be convincing the Danish government a single woman from the Phillipines has the financial resources to fund her trip. If she says her American fiance is paying that shows them both that she can afford the trip and that will not overstay.
