You'll need to describe the nature of the loss, AND why it was a one time thing.  Not here, but in writing so your spouse can take it to the interview.  The loss is evidently described or categorized on schedule 1 of the return.

That is not an explanation.  You know the nature of the loss.  You also know why it is a one time thing, if it is.  That is what you must explain.  The actual schedule one of the tax return, most likely says at least a little bit more about it.

because I will not put any  "nontaxable amount of medicaid waiver payment" if I do that my AGI for 2024 would be what ever I make this whole year . so in interviews CO will  not going look at my current income or its just this year income tax

Totality of circumstances.  I don't find your explanation "plausible" because there is no why to go with the "will not".

You're not paying attention.  They know  you have a W2 income.  They also know that it was fully wiped out to be zero, last year.  Why will that not happen again this next year.  Explain so it can be understood. If it WILL happen again, explain why they should consider all your earned income to be available to support your family.  Explain...WHY

Maybe they know what a medicaid waiver is and maybe they don't.  Is it an actual "expense" your incurred, or just some kind of allowance that has not direct cost (to you) associated with it.  If THEY don't know (not required to be tax experts) then you'll need an explanation they can understand. It's not enough to be right.  They have to understand WHY you are right.

Your tax preparer would be able to explain. If you didn't use one, find one who can explain.

If it is "deductions" that are reducing your taxable income, then you are NOT filing a 1040EZ.  Perhaps your "Total income" line and your AGI are the same, but it is "total income" they are looking at.  With a taxable income of zero, you'll need a minimum of 3 times the full income requirement in "liquid assets" to overcome the issue.

Your primary residence equity is not going to be considered liquid.  Is this a one time tax situation that won't be repeated in 2024.  The totality of the circumstances is what will carry the day, or not.  Without further details, I cannot advise with confidence.

Hello sir, Your statement has caused me confusion as it states sponsors may include the value of their home. Please clarify. Thanks.

USCIS FAQ states that Financial sponsors can only include assets that are convertible into cash within one year. Examples of assets easily convertible to cash are savings, stocks, bonds and property. Sponsors may include the value of their home.

Use the actual instructions instead of the FAQ and you'll read to effect "that are convertible into cash within one year, without causing hardship to the sponsor."  Having to sell the primary residence to support an immigrant is considered a hardship to the sponsor.  Time to become an A-Student of those I-864 instructions.  As you read, interpret literally, no just in a way convenient to the result you seek.

Note, I'm speaking based on significant experience with how Consular Officers interpret those instructions as they do their job.

Thank you. I appreciate your time in answering my question. I'm retired. If I have a secondary residence for rental income will the Consular Officer accept that as an asset?
