Waiver approved but still can be denied?

My father in law arrangements for the 4 younger children to enter the US.  My mother-in-law did cross by herself but her husband wanted the family all together.  We are just canceling everything.  Her lawyer did not inform us of this possibility until recently.

Presumably this was before he got his Citizenship and not somewhere he would want to go now.

She came alone but her husband wanted the family together and arranged for the children to come.  Interesting note that I just found out was my mil tried applying for visas for everyone but they were denied. She made arrangements for them to be taken care of in Mexico and then crossed the border.  She is fuzzy with dates and details though so, it is best that she just stays where she is.  I know she helps in her father's care and is older herself.  Thank everyone for the information.

If she has extended family in MX where she can comfortably wait out the I-601 after interview…the process does not have to be scary. ..and she will get approved…considering the I-601 A was granted .


I understand it’s inconvenient…but she would be able to return as an LPR . ..there is no reform or amnesty in sight .


If you have ever known  friends /family or acquaintances that legalized  after long stretches …first they want to do is visit home country. ..tell her to try looking at it as an extended holiday.

The problem is that she's now drawn attention to herself and her situation. I agree with the above, I'd be suggesting she goes back to sort the waiver and regularise her status. It will be a lot worse for her to be deported than to try and put things right.

Nothing to suggest anyone is coming looking for her, certainly under the current administration.

More immigrants are deported under the current administration than the previous one, 80k deportation orders issued last month - personally it wouldn't be something I'd risk with an elderly relative.

She has been here 23 years, not a problem so far.

 

2500 non criminals were deported from the interior of the US last year, what are the odds?

I seriously doubt that 80,000 deportation orders were issued to Immigrants, I see it happen occasionally, but those sort of numbers no way.

If you look at last FY, and take off those with pending criminal charges or criminal convictions, it was 72k.

Being ordered removed and leaving are very different.

 

There are people who were ordered removed decades ago and are still here. And of course many subsequently adjust having been ordered removed.

 

It is just a game.

See the first link above where last year's figure came from - breaks it down in to removals, arrests, detentions etc (and all can be filtered by criminal records or pending charges too).

I could not see how many were deported.

There is definitely going to be a wave soon, no matter what administration is in place in Nov.

The number of immigration judges has grown under the Biden administration. However, many recently completed cases began under the Trump administration, as cases take an average of 942 days to complete.
