Can my parent get a tourist visa while her I 130 is pending?

I applied for my mom December 2023, her application status still says "actively reviewed". Until recently we had no issues her waiting back on my home country but now I'm really worried that  the whole thing might be jeopardized, due to continuous unrest in Georgia(my home country where my mom is right now). Plus she is of an elderly age and that makes me even more worried about her. I thought maybe it would be a good idea for her to maybe apply for a tourist visa in the meantime and then finish her immigrant visa process here, in the states ( medical, exam, interview etc.) 

 

The thing is, I'm not sure if that is possible exactly. So far, from what I've read online, it seems like it is possible for to visit on a B1b2 while her i130 is pending but she will need to return back to continue her process. it's quite a long distance to travel for an elderly person that never travelled internationally before and the whole thing just makes me uneasy. 

 

Does anyone here had similar experience where they had their parent/parents come on b1b2 and then continue the rest of i130 here in the States? how realistic is that? 

 

I also was thinking about maybe trying to expedite the whole thing?  

I am just afraid, by the time her interview comes, things in my country will be come so difficult and who knows, maybe U.S. embassy won't even be there by then and I'm freaking out. My biggest nightmare is here getting stuck there alone and me not being able to bring here:( 

 

Any advice on the matter would be appreciated!

She cannot enter the US as a visitor with the intent to stay and adjust status.  That is visa fraud.  Perhaps you can re-locate her to a safe area.

Hey, no you can’t bring her with a tourist visa while in pending for immigration purposes! I am familiar with the political situation in Georgia, I wouldn’t worry too much tho, everything will work, patience. We always see things differently from here, I wouldn’t watch news, last year I thought Europe would be wiped out, went to visit family and everyone is clubbing and enjoying life. I was in the same situation you are right now, except I am adjusting status from tourist visa , yes it’s possible but not with form 130 in pending and even if you cancel, they would see it… “have you ever applied for an immigration status bla bla “ !  I am from a neighbor country, adjusting status from here , not easy, I don’t do vax, not easy but I’d pack my stuff any minute and go back home. What they want us to go thru it’s insane!

To be clear, since she is not currently inside the US, adjustment of status is not an option.  I know it seems ticky-tack, but the rules are the rules, and people are not allowed to enter the US on a visitor visa with the preconceived intent to stay and adjust status.  That being said, she can try and get a B2 visa to visit, but it will be a hard bar to overcome her immigration intent since there is a pending I130 for her.  You can also try an expedite (possibly under humanitarian grounds) of her I130 petition (slightly faster, but by no means immediate).  Hopefully you have also considered the high price of healthcare here in the US.

No, that is fraud.   Also unlikely she’d even get a B visa.

 

On what basis would you try to expedite?   They won’t expedite because you’re tired of waiting.
