Hello. My boyfriend and I are getting married in a couple days and our I-130 interview is coming in two days after our marriage. (I know. Sounds impossible, right? But there’s is a lot of stories on behind…) And I have some concerns about filing I-130.

Question 1

If I change my sir name now due to a marriage, will I have to change my sir name on my passport before filling I-130?
Or could I still use my current passport that has my maiden name on? And so long as I have the certificate of name change, would it be okay?

Question 2

Since our marriage is less than two years, we have to provide a statement of how we met. But I don’t know how to write it. Can anyone give me some examples or a templates?
Also, what is the proof of on-going relationship? Is it also some kind of essay?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Should be fine, you can change any names on the I130/DS260 at the interview.

I would use the template fiancés use for intent to marry and modify it for your purpose.

Good Luck!  I would love to hear the back story, if you are willing to share, as to how your case ended up like this.

Thank you so much for your answers! That’d really appreciated.

Yes, sure thing:)
first of all, my boyfriend is a US navy, stationed in japan and I myself is Japanese living in japan.

So, long story short, we found out that we are having a baby back in March. Though I was attending to college, we both agreed to keep our baby. I dropped out school, and we decided to settle down together. Our baby is coming on September. So i need to get visa as soon as possible.

Unfortunately, he has to go back to the states in like a week. And he will be stationed there for over a year. So It will be so hard for both of us if we cant get these things done now…. You know, in many ways…

We had about two months to prepare but we wasted the first month working on K-1 visa. Only to find out that we couldn’t file because he was not inside the states.

From the very beginning of April, we started working on CR1 visa which we are trying to get. But before the visa we had get married.

Since my boyfriend is in the navy, he has to get his marriage affidavit from the navy which took forever than it usually does. Only if they did it soon, we could have gotten married two, three weeks ago. We would have had more time preparing for visa.

Now that we finally have the affidavit with us, next Monday morning we will go to city hall and get the remaining stuff we need for i-130.

Our original i-130 appointment was also on Monday. We were this close yo give up on the visa. But with a slight hope, i talked to the embassy all day the other day and they allowed us to walk in on Wednesday. So yeah, hopefully, we will make this whole process done.

It means I moved the topic to the military related forum area where other military immigration matters are discussed.

No action needed.  I just placed the entire thread in the appropriate forum. All is good.

It sounds like you are doing DCF, so I guess it can be that fast particularly when a member of the military is involved.

Good Luck!

Members of active military have access to immigration liaison personnel and a special hotline to USCIS.  In your case, it sounds like USCIS will not be involved and the embassy (DOS) will directly handle the I-130.  I would advise you to prepare all your paperwork and have your required documents ready (passport, police record, birth certificate, marriage certificate, etc.)
