Wiretapping Law Casts Pall On Democrats

I can't help but chuckle whenever I hear Dems talking about violence being done to the Constitution :rolleyes:

Too many basing their facts on the movie 'Enemy of the State'..

According to the Internal Revenue Service, the 400 richest American households earned a total of $US138 billion, up from $US105 billion a year earlier. That's an average of $US345 million each, on which they paid a tax rate of just 16.6 per cent.

Hint # 2. Up until a few years ago guess which party had a majority on the Supreme Court? I wonder if there is a correlation?

Whenever I hear the term unconstitutional I just roll my eyes. Why act like the constitution was written by God himself. What about right or wrong? What about being relative to the times?

Only a fool would think something created many centuries ago, relative to those times, should still apply literally word for word in todays society.

What kills me is that if there was a Bin Laden during the era the constitution was written, would they have not factored that in and made the appropriate exceptions. Here we have people trying to apply laws written prior to the existence of any electrical technology into todays society.

The point of a constitution is to set down absolute values about certain general principles that should never be compromised. For example, the right to a due process, the right not to be tortured or persecuted.

This is why I’m no fan of Leo Strauss, as he believed that the constitution was a nice to have - that could be thrown aside at a moments notice. That might be true for countries which are politically unstable, but for a 1st world nation to do this opens up a potentially very ugly can of worms (hence the German Weimar constitution was effectively neutered by 2 pieces of subversive legislation. Clearly that did not turn out well).

In this case, there is a valid point about the separation of powers. The surveillance programme, I believe now comes under the remit of the FISA court, when previously it didn’t. At least now there is a small element of control over this. As I said – I think the biggest criticism of this was with the warrantless part.

No, I don't think that way, Gary...sorry. They may have their ideological leanings, but they should recognize they are one branch of our government and fulfill their end of that responsibility...mainly to review laws on their constitutional merits. They aren't politicians nor should they be. It's like doctors and their hippocratic oath.
