Hi I am us citizen married with Korean citizen who is in the us currently. My last year income is $190 less than 125% guideline for household two. Therefore i want to use my fully paid house as assets to make up the 3times difference which is $190x3=$570 

in order to submit the house what kind of proof do i need to submit? And how & where can i obtain them? 

deed? Appraisal value? Market price of the house?

There is sopmething on the I 864 about assets you can realise without undue hardship, and selling your only residence is usually considered a hardship.

I sale this house and buy other smaller house in the future.

in order to submit my property as assets what documents do USCIS require ? what about submit additional my bank balance averaged in 12 months as long as showing it is way over $570 ?

As explained above, you can't use it as an asset if it's your primary residence, regardless of your future plans for it. 

 

You'll need something else.

Are you seeking a spouse visa, or to adjust your spouse's status from within the USA?  In a visa case, USCIS does not make the decision about the I-864.  That's submitted a year or so later.  If it is your plan to sell and move, then you have plenty of time to do it.  You also have plenty of time to increase your income.

It is to adjust my spouse's status from within the USA, this year i am earning way higher than last year and last year only $190 short off, i did submit two of this year paystubs and 1 current balance in joint account but uscis still sent request evidence so i have to use assets this time due to hard find cosponsor, what documents can i use as assets in this case ? Thank you

I believe, but maybe I'm wrong, the requirement is an official appraised value (from certified appraiser). However, as previously mentioned I believe you cannot use your primary residence as an asset.

You do not have to qualify based on last year's income.  If you are making more now, state your current income and document it with a pay stub.  Calculate your current income by multiplying y our gross pay for one pay period times the number of pay periods in a full year.  You can submit a whole new package.

 

What exactly does your RFE say about the affidavit of support?  When did you submit the package?

i did submit i-485 i-864 on march 25 2024 and included two paystubs of 2024 which earns multiple higher than 2023, plus a bank balance with couple thousands. now they sent request evidence says not meet 125%guideline needs cosponsor or assets, i want to say 2024 payment is multiple higher than 2023 guideline, but they still ask me to provide co sponsor or assets, so i have to use  my premium house and my current bank balance. what exactly should i submit as assets? and how to obtain them , thx

based on the docs submitted, we could not determine that the petitioning sponsor on form i-864 affidavit of support is qualified , in order to be a qualified sponsor the petitioning sponsor's form i-864 must be properly completed and signed and the supporting docs must establish that the petitioning sponsor's income meets 125% of the federal poverty guideline for the sponsor's household size,see form i-864p for information on the federal poverty guidelines. if the petitioning sponsor's income does not meet 125% of the federal poverty guideline for their household size, you must obtain a qualifying joint sponsor who demonstrates the ability to support you or submit evidence of assets.see form i-864 instructions for more information.

You cannot use your primary residence house as an asset.

Give them what they want - a qualifying joint sponsor.

 

Based on what you're describing so far, you don't have assets you can use for I-864.

Is this an actual request for something? If it is, it will say so at the top of the notice and spell out exactly what they want you to send them and how.  Please provide full context of the text minus any names.
