My 2023 IRS transcript is as follows,

Wages as per W2 = 78,000

Partnership loss = (35,400)

Total income = $42,600

 

1. What amount should I supposed to mention in I846- affidavit of support as most recent year total income? Is it W2 value or loss deducted value?

 

2. My household size is 3, and income requirement is $32,270 as per i864p. If I have to mention $42,600 as income for the year 2023 in i864, will this amount be sufficient? will there be a risk of getting a RFE requesting a joint sponsor?

 

3. I have to mention 2023, 2022, 2021 income information in the form I864. In 2021 I have submitted taxes jointly with ex-wife and I didn’t make enough money in that year, and I only have a month’s W2 form. IRS transcript of joint filling is available. What should I suppose to do to complete 2021 income information? What among should I mention? And what supporting documents should I upload for 2021?

There's always a risk.  They could see the $78k number and still decide you need a joint sponsor.  It all depends on who reviews the paperwork.

 

Make sure you provide information on your current income in addition to your past income.  If they can see this year is trending towards that $78k, it's more likely they'd take that and "overlook" the 2023 numbers.

Thank you. currently I am getting over $100,000 annual salary. I got an employment confirmation letter mentioning my annual salary from my employer.

I won't promise you that you won't get a request for a joint sponsor.  But I did my mother-in-law's IR5 last year, my wife and I combined are about where you are in your current salary, and we didn't need a joint sponsor.

While past years' filings are important, they are weighted differently.  You will file for all three years...that's compliance.  All you can report is what you have.

 

You could also check with the Social Security Administration.  They should have a copy of how much income you had in each year for Social Security purposes.  That might be a better number. Your Social Security Statement is available online.

 

Try to give them everything you've got for those three years.  You don't want an RFE if you could have avoided it.

 

The important part is that your income is getting better.

Whether sufficient or not, you enter the total income number for all three years, in the tax section.  Yes, same even if filed with your ex.  If the loss is an outlier, then your current income would be your gross salary for a pay period times the number of those pay periods in a full 12 month period.  (bi-weekly times 26, for example).  Tax section is about the past.  Current income is not about the past.

 

Current income is documented with your pay stub, not your tax return, unless you are self employed.  Looks like you are both employed and self employed, but you qualify anyway.
