Hey guys, we have an RFE notice. Hubby and I were out of town for 2 months only to come back and find the RFE drenched and wet in the mailbox. We're panicking as we didn't have too much time left to compile the evidence and I'm shipping it out tomorrow morning. We filed early Feb 2022. On the RFE notice it says "you've submitted  the following documents:" then goes on not to list anything. And then it says not to submit the same evidence again. I'm confused as to if they lost my evidence and I need to resubmit it or they aren't considering it as it's outdated and I shouldn't re submit it. Any advice? I'll attach the notice.

As a reference, here is a list of my supporting documents from my original packet: 

 

-Conditional Permanent Resident Card Front and Back (copy)
- Passport Biographic Page(s) and SSN card (copy)
- Letter from Petitioner about supporting documents
- 2020 Joint Tax Return Transcript (copy)
- 2019 Joint Tax Return Transcript (copy)
- 2020-Current Apartment Lease with joint occupancy (copy)
- 2018-2020 Apartment Lease with joint occupancy (copy)
- Photos
- Airline E-Tickets and Flight Itinerary of our travels
- Emergency contact of eachother at Doctor offices

They're probably looking for more evidence. I'd send everything you have.

 

What about joint bank account statements and utility bills? Do you have any of those spanning period from date of marriage until now?

 

Essentially they didn't think what you sent was enough or up to date to approve your case.

We never included hubby on the bank account and he just used mine. I know this sucks but we've been traveling back home and staying there months at a time that hubby just didn't find a job in the states so there was no need for him to deposit funds etc. As far as utility bills, we live in a condo owned by a family member who takes care of those payments for us and we just pay a monthly sum.

Anything can happen - NOID, denial or interview.

 

Can you get 3-4 swarn, notarized affidavits from friends / colleagues / neighbors who know you as a married couple?

 

Did any of you add the other on health or car insurance?

Do you go to the same doctor? Any letters from the visits?

Submit all tax return transcripts, from 2019 until 2023?

Any copies of IDs or DLs showing same address?

Any letters addressed to both of you?

Any hotel reservations with both names?

Costco / Sam's club / Amazon family / National parks or other joint memberships?

You need to get creative.

What is NOID? 

 

We have two affidavits (one from each side of the family) however not notarized, we had no idea it had to be. 😭

We don't have car insurance but hubby is included in my Food Stamps documents as well as medical assistance docs. 

We have a lot of doctors notices with our addresses however we don't have the same doctors we see. 

I have tax transcrips from 2019 to 2021 when I lost my job. 

Neither of us have a driving license. :( Or a state ID. 

 

I  will look for any other bits I can add.

I agree, ID is a must. I think a lot of people try to save money but that works against them. Only recently read a thread where the person didn't have any valid US ID and their foreign passport expired. Not a good spot to be in.

We've just always used our passports everywhere. I know it's not ideal and I wish we planned this sooner.

Failure to respond to that RFE is a guaranteed denial.  Failure to answer the RFE sufficiently is a guaranteed denial.  Now is the time to throw everything you have at them.....especially evidence showing you live at the same address, evidence of shared expenses, and evidence you are actually sharing your lives together.   Normally, such evidence should be plentiful.  Concentrate on what you have. 

 

 Good luck.  Now is the time to think about what evidence you can muster.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am still not getting answered what I ask. Do I have to resubmit my old evidence alongside my new and current ones? There is nothing listed on my notice under "You provided the following evidence that the marriage was entered in good faith." 

 

Like it just moves on without listing what they already have from me.
