130A Physical Address question

Hi everyone,

I’m filing i-130A for my spouse who is currently working in Taiwan but he is of Vietnamese citizen. When they ask for the physical address for the last 5 years, do I put his work address in Taiwan since he stays at the company’s dorm or do I put his permanent address in Vietnam?

He plans to reside from the company in a year or so, we just don’t want to miss any noticed coming from uscis if they will send him notices to his physical address. Also, does USCIS send notices via mail to spouse beneficiary oversea?

His physical address is where he actually is or was.. USCIS will not mail him anything.  Beneficiary will not be sent anything physically until his passport is returned after his interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

Interpret the questions literally and answer accurately.  A Physical address is where you live.  A mailing address is where you receive mail.  Often they are the same but not always.  Clearly, he does not currently live in Vietnam.

Thanks for your replies. Another question is: since he is currently living in Taiwan, but he is a Vietnamese citizen and plan to apply or interview in Vietnam, in question 

"At which U.S. Embassy or Consulate location will the beneficiary apply for an immigrant visa?" 

Choosing a U.S. Embassy or U.S. Consulate outside of the country of the beneficiary's last residence does not guarantee that it will accept the beneficiary's case for processing. In these situations, the designated U.S. Embassy or U.S. Consulate has discretion over whether or not to accept the beneficiary's case.

 

Can I just put Ho Chi Minh city, Vietnam? since his last residence is in Taiwan, can the U.S embassy in Vietnam deny his case? I'm just not quite sure if "Choosing a U.S. Embassy or U.S. Consulate outside of the country of the beneficiary's last residence does not guarantee that it will accept the beneficiary's case for processing." apply in this case.

My question is can he be interviewed at US Embassy in Vietnam? What is the difference between applying for an immigration visa in Vietnam versus Taiwan?

When filing for I130 online, it asks to provide the location of US embassy that we wish to apply for an immigrant visa but further warns that it doesn’t guarantee the case will be accepted if we provide the location of the US embassy in a country different than the last residence. As follow:

"At which U.S. Embassy or Consulate location will the beneficiary apply for an immigrant visa?" 

"Choosing a U.S. Embassy or U.S. Consulate outside of the country of the beneficiary's last residence does not guarantee that it will accept the beneficiary's case for processing. In these situations, the designated U.S. Embassy or U.S. Consulate has discretion over whether or not to accept the beneficiary's case"

He is living in Taiwan, does that mean he may or may not be able to interview/apply for an immigration visa in Vietnam? I'm a little confused.

Please help.

Yes, he can interview in VN.  By the time he completes the DS-260, he will have returned to VN.  NVC will assign the case to the consulate where he resides at that time.  Even if NVS assigned it to Taiwan, the location can be changed.

NVC.....WILL assign it to Taiwan, no matter where you said you wanted it, but you can request that it be changed to HCMC.
