I've looked all over visa journey and can't find a clear answer to the following questions:

Can my fiance, a k1 visa holder, attend school (a university), during the initial 3 mos and while the AOS is pending?

Does he need an addtl' Visa?

If you've seen that this question has already been answered on Visa Journey, please send me the link.

I do belive that she can. However, she will likely have to pay out of state tuition rates.

No special visa required, though residency requirements at the university may be an issue. Many colleges and universities that are state run have residency requirement for the tuition rates, they give people who have lived in their state for more than 1 year as a state resident a lower rate.

Check with the admissions department of the school you are interested in.

While I didn't register for full time studies when I arrived, I did start a community college program through the extension division. I was informed by the college that I could attend classes but I HAD to have a SSN number. I was granted the same fees as a resident. Please note however that this is for an extension non-credit class. If your fiance wants to attend credit classes, on a full time basis, there is a huge procedure to go through, with the reading of transcripts, equivalency of credits etc.

You should also get your finace a SSN card soon after she arrives. Of note is that I only have a card in my maiden name right now, as I'm awaiting my AOS interview, however I registered with the college with my married name. They indicated it didn't matter as it will be the same number after I marry.

I'm due to start full time college (community) this month. I applied last month, before I was married and before we sent AOS off. It was easy enough for me. I had my certificates for my GCSE's and ALevels from the UK with me and they accepted those no problem. I mean, why shouldnt they right? Lucky for me, my husband is in the airforce and so the college I'm studying with allowed me to have the 'resident' fees even though I'd only been living in AZ from less than 1 month!!!

O yea - and I did need my SSN

Good luck x

My husband is now attending a community college. He was enrolled while still under the K-1 with a copy of his visa and his AOS NOA1 as proof that he qualified for 'in district' fees. That isn't the same as many four-year universities which may have residency requirements to actually get the lowered tuition, while community colleges just require proof that you live inside their district (at least that's all mine required).

You shouldn't have too much of a problem, but it wouldn't hurt to contact their admissions department and possibly their international admissions department and see what kind of information you need about your spouce's past education and what they would need to provide for enrollment.

Our K-1 Visa/AOS/RoC timeline can be found here.
