Hello!

 

I have a pending I-485 since March 2023. My mother needs care thats why I spent much time outside the US, about 7 months.

And now my husband got request for evidence for i-130: "Submit evidence that proves that you have a valid marriage, and it was not entered into for immigration purposes". We need to rensponse till the end of May. 

The problem is that I need to help mother during her surgery, so I need to leave the US for few months again. But I am  worring about this sitution. I have a multiple AP now. Maybe I should give them additional evidence or something else?

Has anybody same experience?

AP is not intended for spending large amounts of time outside of the U.S.   also-  what will you do if your AOS is denied while you’re gone?   You do realize you wouldn’t be able to come back, right?

You must give them evidence of bonafide marriage otherwise USCIS is going to deny your case. What evidence did you submit so far and what are you planning to submit in response to RFE?

It was an emergency sitiation and I really hadnt a choice. I realize it, that's why I am asking here for advice.

We submited photos, travel tickets, money transfers, and 1 letter. 

We have insuarance policies, water, electric bills, leasing appartment, pictures of wedding. We didnt list yet all evidencies that we have.

You need to add updated evidence ANY evidence you haven’t already submitted. include an explanation on why you haven’t been living together. (Add evidence). And your plans to reunite. 
 

Additionally, weigh up the options

 

1. is GC more important than taking care of your mother

2. If the case is denied while you are out of the country are you okay consular processing 

3. if called for an interview can you return in time


You must reply to the RFE though… otherwise your case will be denied.
