IR1/IR2 visa process - started in beneficiary country of residence, can we finish it in the states?

Hi

We started the IR1/IR2 visa process in Israel.

Our current stage is :  We received NOA2 (documents approved) on Jan/2024, and are currently on waiting for Interview to be scheduled.

 

 

Situation at our country is not very stable/secure, and we are considering our options.

 

If the applicants enter the USA on tourist visa, can the interview/process be completed in the USA? 

 

What are our options here?

No,  the Person can not enter the US and interview for spouse visa and planning to Adjust here is a violation of immigration laws

 

and USCIS can expedite if the USC has reasons to do so but unfortunately many countries have wars,  threats of war ,  famine and other disasters and USCIS if not able to help everyone

No.  Visas are issued outside the USA, not inside.  You can leave Israel and go anywhere.  You only need to return for the medical and interview.

Can the applicants visit the USA in the meantime on Tourist visa (which they do not currently have) or using the recently allowed Visa Waiver process for Israelis via ESTA?

 

or would this not be looked kindly upon by immigration officers ?

They can try to visit but it will always be up to CBP’s discretion to be admitted.

Yes, you can visit on a tourist visa and it is unlikely that you'll have any issues with border patrol. Getting a tourist visa might be a challenge, especially since you're so far along in the immigration process.

They may suspect (also as evidenced by your inquiry here) that you will not return to your country.

I should have added, my wife got her tourist visa before got engaged and has visited me several times while the IR/CR1 process has been going on. She had no issues entering the US.
