Even with a new CO, the notes from the previous interview will be in the record.  You need to address the issue, as others have said maybe contact your US House member or US Senator to see if they can shake the NOIR/NOID loose from USCIS, you can also try the CIS Ombudsman.  The issue needs to be addressed, and since it seems you don't know what that issue is, you need the NOIR/NOID.

You need to know the reason the first was returned and address it. The NOIR is very important so wait for it or find a way to figure out the issue. Don't throw away money by filing a new one.

You can’t overcome reasons for denial by refiling.   Do you really think there is no record-keeping in USCIS/department of state???

 

You may want to plan to move to his country if you want to live together.

I have been waiting almost a year for the NOIR and still have not received it. While I'm waiting I should just refile and continue to wait. Cos even if i do get the NOIR after a year I will have to refile anyway. I may even get approved for another interview during this year if I refile. Has anyone ever had that happen?

If you refile you are looking at 18 months or so. You will get an interview and you will of course need to make sure you address whatever the issue is.

I'll add my advice to that of others and my own previous advice.  Unless you understand the problem first, it could harm your eventual result, to file without addressing the issue.  My advice is to wait for the NOIR.  You could contact your US Senator's local office to inquire on why the NOIR is taking so long.  I get that this is not what you want to hear, but it is still the correct advice.

Ok I am going to try my Senator. I will let yall know how it goes.  I called the USCIS and even the representive that took my call says that i will have to refile after a year has passed cos they dont have it at their office.

The last time i filed it took 13 months to get approved and then 7 months to wait for interview letter so the wait is about the same.

I think the issue is because we did not celebrate after our wedding and my husband told her that. We did not have the money for a big celebration so we just got married and had drinks with his brothers. So it kinda looks like it was just for immigration purposes.

I go there every year and stay 3 weeks each time. We married in March 2021 and I've been  traveling there every year since. Im even traveling there twice this year.

If I understand your timeline, you’ve been married for almost 3 1/2 years and have spent a total of 9 weeks together after the trip during which you married.  Some questions come to mind.  If you don’t want to answer them here, fine — but still something to think about that the consular officer may have considered.  Nite that this is not a comprehensive list — it’s a starting point:

  • Hiw long have you known one another?  How did you meet?
  • How long after you met one another in person before you married?  Did you marry on your first in-person meeting trip?
  • Do you have a significant age difference? If so, is that culturally acceptable in Gambian culture?
  • Major difference in religion?
  • Great difference in educational level?
  • Language difference (I know the official language of Gambia is English, but still an important question, just in case.)
  • Do either if you have children?
  • Were either if you married before? Multiple times? International marriage requiring an immigrant visa?
  • Were both families supportive of the marriage?

None of these issues by themself would be a problem; however, if many of them apply, taken together they may form a pattern cause concern about the validity of the marriage.  
 

I can almost guarantee that the issue was NOT the lack of a large celebration after the marriage.  People are married in simple ceremonies (civil and religious) without large celebrations all over the world and still get issued US immigrant visas.
