I really need help. I filed for my husband to come and we were denied after his interview. Never was a given a reason why. its been almost a year since this happened. Was i suppose to get a denial letter be cause iam the petitioner? i never received anything. They just gave him a paper saying that it would be sent back to USCIS for review but USCIS says that never received it. Now my question is..Should i refile another petition and if i do refile do I use the same ceac site I used for before?

This often happens because some applicants do not come prepared with all the required documents for their interview.

I'm sorry to hear that. However,  you have to wait until you receive the letter that state the reason why your husband was denied the visa,  you will surely get that letter. 

Then you file for an appeal with your proof of evidence that your marriage is not a fake marriage. Start gathering all your evidence now ,waiting for that letter because it will surely get to you.

Did you review everything that was asked in the interview?  What were the differences?  You say the petition was sent back to USCIS with no reason, but there must have been something the CO picked up on during the interview to make them believe the visa should not be issued.

That will be difficult when the OP doesn't know the reason(s).

I have yet to see a case where they did not have a pretty good idea of what the reason us.

The CO must have picked up something that the interviewer told him on his case for a denial returning it back to USCIS.

True....That's a good point.  In this case, it seems the CO had doubts about the authenticity of the relationship. Looks like bothe the petitioner and interviewee were questioned.

From what I'm reading in this thread.. OP... is missing a key part of that interview.. the CO.. must have said something and both of them did not understand what was said.

I'm guessing like we all are.. but something is missing..

This is something a state rep might be able to help with (to locate the petition)

he/she can not find out the reason for denial but should be able to tell u if it is still in Sengal embassy since USCIS says they do not have it

BTW site says Gambia and VJ Members need the correct country /embassy to give best advice/  past post u say Sengal

 

AND NO to filing a new petition/  if u don't know reasons the 1st was denied October 4,2023,   u would be unable to correct the CO's understanding of the relationship

 

u do need the NOID or NOIR  to address the issues with actual proofs of relationship or to file a new CR1 and address them in that petition  

state representative will need a signed release from u to do an inquiry

"State Rep" means a politician at the State level.  That won't help. You need your US Congressman, or preferably the Senior US Senator from your State.

Seems like I'm going to have to refile, and just hope he gets another CO at the next interview. Do you think they will have the info from the last interview? and will they be able to tell that I'm refiling?
