AOS denied - USCIS claims Korean evidence submitted was not what was asked for in RFE [title edited to specify country]

My wife just received a Notice of Decision (denial) in response to her I-485. After speaking with our attorney, and an extremely helpful and friendly USCIS Employee (/s), they are saying that we submitted evidence, but not the right evidence.

 

In an RFE USCIS asked for “the Basic Certificate (Detailed) and the Family Relation Certificate (Detailed); OR Submit the Family Census Register and the Family Relation Certificate (Detailed).” My Wife submitted those documents, titled "기본증명서(상세), and "가족관계증명서(상세)" on the original government documents. The title of the official translation in the notarized documents were "Identification Certificate (detailed)" and "Certificate of Family Relations (detailed type)". They acknowledged receipt.

 

(I'd like to point out that the "Identification Certificate (detailed)" was previously used in a her K-1 Visa Application which was obviously approved) -You forget the K1 visa was issued in Korea by someone who 1.) sees these documents everyday and 2.) probably didn't even glance at the translation/translated page

 

 

Questions...

  • Did USCIS not like the translation of the title? - YES

  • Did USCIS make a mistake? - PROBABLY

  • Does she leave the country and start another process? - NO

  • Do we file a motion to reopen, or motion to reconsider?

 

It is a pity they are denying your case because the adjudicator doesn't know what the official document is supposed to look like and went by the translation. 

This doesn't happen often but it does happen often enough. I don't know if you need to get a Korean lawyer. Easiest fix would be go online and evidence  the documents your provided are the documents requested. 

Here is a link to guidance provided by US Embassy Korea. It has a translation sample. I would maybe re-translate the document in this format if you are going to submit another AOS petition. 

I'm not sure how you want to proceed... but you need to tell the lawyer you have the correct documents you just need to translate it to USCIS's standards. 

 

Another poster had a similar issue: USCIS didn't like the translation.

It also happens to Iranians as well , as the translation come through with headings of ‘identity ‘document . 


‘I don’t fault OPs attorney as it is one of those rare occurrences but I do hope they take a strong position on most effective solution and I-290B filing.
