Returned Packet after April 1st

Update: I called USCIS and they said I won’t have to pay the additional fees as long as I resubmit it within the next two weeks!

 

Hi all,

 

I sent my AOS application on the 28th of March but unfortunately it was returned as I accidentally missed one of the signature sections. Will USCIS waive the new fee if I send it back immediately or will I have to pay the new fees?

No you will have to pay new fees as far as I understand. Your packet got rejected and the new packet will have new date, meaning new fees.

I actually called USCIS and they said if it didn’t state on the notice I received that I had to pay the new fees then I wasn’t required to pay the extra amount thankfully!  
I’m going to leave this up incase anyone else faces the same issue.

Yes, you called up USCIS and spoke to Tier 1 support person. They told you whatever you want to hear to finish the caller sooner and reply to next person. I would not believe anything Tier 1 says.

 

Think logically... For packet to be accepted with old fees, it should have been post marked before April 1 2024. Now the packet will be post marked  after April 1. How do you expect USCIS to apply old fees? Rejected packet is almost the same as the packet that was never filed really.

 

I understand the desire not to pay increased fees, but I'm 99% sure your new packet will be rejected if you don't pay new fees. You can try and update us here.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Did they return the first payment to you?  If so, you MUST send payment for the new fee.

Yes they did. We’re going to try and resend it first with the old fees and see what happens.

Unless you have clear, written documentation from USCIS that supports what you were told over the phone, I don’t see how anything other than the fee as of April 1 could be accepted.

Of course I want you to succeed..as does everyone else engaging in your post.

Based on what USCIS public position , not possible …don’t lose heart if they bounce it back …

$1,440 for I-485

$   675 for I-130

So $ 2,115 to resubmit the important bits ASAP.

Some non-profit organizations are offering very low interest rate loans (1%) for people in your situation.   Do not delay filing because you are unable to afford it, ask family, a friend, or look up for such a non-profit.  Best of luck.
