Confused about next process on I-130

Hello!

 

I am a little confused with the instruction on the approval notice and the NVC website regarding bringing my parents here to the US. 

 

Fortunately, my mom’s I-130 got approved today. Now, after I get the approval notice in the mail, I want to do the next step - which I understand is the NVC since they are outside of the US. 

 

My dad’s approval (December 2023) notice says to file form I-824 and pay the filing fee so the USCIS will forward the form to the NVC. The NVC guide says the USCIS will transfer the case to NVC then I will file the forms they need there. 

 

I have not gotten any welcome mail or email with the case number from the NVC. I checked the guide here, but it didn’t answer my question. I also sent an inquiry to the NVC, but I thought someone here may know the answer. 
 

Can I get some guidance please? Thank you!

Timeline

The only reason to file an I 824 is if you had specified in the I 130 that they would be adjusting and not Consulate Processing.

Oh goodness. I had to double check! No, I did not do that by accident. Do you think I have not received any mail from the NVC because my parents' applications are connected to each other and my mom's just got approved today?

If they’ve asked you to do the I-824 then it’s because there is some confusion about whether your father is applying via consular processing outside the US, or adjustment of status inside the US. The question is is that your error, or USCIS’s error. What did you put for questions 61 & 62 on the I-130? 

 

And have you submitted the I-824 as requested?

This is going to sound really dumb, but 61 and 62 says Saint Paul, MN. I don't even remember putting that on there. What can I do at this point? Do I need to resubmit the entire thing?

OK. All you can do is pay the fee and submit the I-824 as requested (if you haven’t already). Unfortunately it will add quite a bit of time to the process but your mother can pause things at NVC to allow time for your fathers case to catch up.

It says both on their applications Saint Paul, MN. I am so frustrated right now with myself. Can I send them an email saying this is a mistake?

No, you have to submit the I-824. There is no other way to fix this. Unfortunately you can expect a request for one for your mother too if you put the same thing on her application.

Okay. Thank you for clarifying. Would I need to pay a fee at the NVC again?

You won’t need to pay any fee twice, but you’ll need to pay USCIS a fee for the I-824. https://www.uscis.gov/i-824

 

I’m sorry, I know it’s a total pain and waiting longer and spending more money will be the last thing you want right now. But hopefully this is just a blip and the rest of the process will go smoothly. Good luck.

You could refile the i 130s

Yes, but not until you have the Welcome Letter (after the case is at NVC). And depending on the processing for the I-824 you might want to hold off doing that for whichever parent is approved first - depending on the service centre they’re sent to the processing time could be wildly different. So if they want to interview and move together you might want to slow down the NVC process for whoever is approved first.

I assume you filed on line.

 

I think there is a lot to be said with filing a clean new application
