MARCH 2024 I-130 FILERS FOR SPOUSE

I got one of those cryptic "an action has been taken on your case" messages last week, like many people did it seems, BUT nothing has changed in my Case Status or Notices section.

MyProgress went from 15 months to 4, but we know that's not to be trusted one bit.

American citizen, PD 3/30, VSC, online filing, South Korean spouse, solid evidence (in relationship living together for 7ish years, married one month) - so not worried about things like RFE or any questions from them ( we even have random stuff like my will, bank statements sending money within Korea  and boarding passes from flights 7 years ago)

I haven't recieved one of those messages but today, my progress changed to 5 months from 2 weeks and then 2 months.  It's quite interesting to see the numbers change so much and all over the place.   At least with the changing, it gives me something to look at on my account.  :)

I'm in a similar situation, married to my husband for 21 years and sent something to document our lives together over the 21 years.  I probably sent way too may photos though!

US citizen moved back to the states with our children to file, husband remained in England

Aww, crying with you on that one.  Even though we know they aren't accurate, its worse seeing such a high number.  Hopefully, that will drop next time you log in.  I'm holding on to the estimates on their site and the estimate I got here.  They both are about the same.

We filed our I-130 on March 28th 2024 at the Texas service centre. We received the "we have taken action on your case" email on 15th April 2024, with no update on the my account or document tab. Today we are still on the "Case has been received and a receipt notice has been sent" with no updates.

My progress shows 2 months and it's always shown 2 months

The I-129F is only for fiance applications, spouse can only use I-130, that's why I'm confused as to why you would file the I-129F

The I-129F is also for the spouse if you want to try for the K3 visa.  It is another option that you can only file with the I-130. It is part of the Life Act that was put in place for USC petitioners only.

I was just reading about it and there is no real current timeline for the application.  Boundless esitmates about 19 months so really, a similar timeline.  The state website says it depends on the case and the processing but obviously, it comes with less restrictions than the I130.  Another website said it is between 4 and 19 months.   I would give it a go but I have to live at my mum's house for at least 6 months before I can combine my income with hers for the affidavit of support.   It also looks like you end up with an additional fee but well worth it to get our loved ones here!

Let us know what you decide to do.

Thank you, I sent mine off 4/24. I am hoping it will push my I-130. It is not guaranteed but there has been many reports of it pushing them to view the I-130 and ultimately making a decision to deny/approve one or the other. It may not do anything but filing this form is free. I also read that it should be filed within 30 days of submitting the I-130 for it to possibly get looked at.

I will update my timeline if and when I get news.

Ah yes, I read about this just now! I had no idea! BUT in my case - we are not separated, we live together in Korea, sooooo I am sure K3 would be swiftly denied for me AND the govt website says "I-130 often is faster anyway" haha
