5 or 6 years for K1 VISA??!!!

more than 500 Days ago and we are still waiting for NOA2,My Fiance Called uscis yesterday and they told her:that maybe can take 5 or 6 years :crying::protest: .please who heard of a story like this?how that can happen?some they get the visa after 5 months and some after 5 years!!!is that right???

:o I'm so sorry to hear that! Is your case complicated? Divorces, birth certificate issues, criminal history? Have you contacted your congressman? If so what was his or her response?

It really shouldn't take 5-6 years for a K1, but there can be issues that will make the process much longer.

USCIS customer service is not the best and all of the timeline estimates I ever got for them were wrong- thank God! Where are you from? Sometimes the country matters. I know the Domincan Republic takes about 2 years. But it only took us 5 months in Ethiopia.

Such stories are rare but do happen. The 5 or 6 years would refer to waiting for a priority date though. That doesn't apply to a K1. You must be in some sort of administrative review for a reason you probably have some clue about. Next time you call USCIS misinformation line, follow the prompts for having received a request for additional evidence and make sure you talk to an actual agent. You'll get better information if possible. Those stuck in administrative review are not going to get much, if any information and certainly no estimate of how long before things are moving again.

At some point you could consider hiring an attorney to file a writ of mandamus.

I suggest you contact you elected representative, this is just way too long to get the approval.

All I can say is that I will pray for you, I feel awful that you have been waiting this long....but you are saying that you never received anything that would cause this delay? What have you been doing in the mean time....I mean with your relationship?

Timeline

Go to your State Senator's website and download and fill out the privacy form. Attach a page briefly detailing the situation and request an inquiry into the status of your case. Fax it to the senator's office, call to follow up and get the name, direct phone number and email address of the person assigned to your case. Stay on top of that person. If they are not helpful, repeat the process with another office location or the other senator.

It sounds as if the foreign fiance is stuck in security checks and once cleared, the petition will be approved.

Never call USCIS for information or listen to anything they say. This is not a 5 or 6 year process.

Hi Mellar,

I notice that you've basically asked the same question since just after you joined. You also indicate that you or your fiance has already contacted a senator and congressman. Maybe you need to get back to them again, as I'm sure they still have a file open somewhere. I think it was from December or February of this year, you indicated that you are "under special investigations". Heaven knows what that means. It seems your fiance is the USC, so maybe there is some missing information.

Based on the OPs previous posts, he contacted a congressmen at the 11 month mark. Did you hear back? Maybe time to get in contact again or with a state rep.

I also saw that you had an RFE in July of last year. Did you get a notice that they received the RFE info? Maybe it got lost and that is what they are waiting on. I know the USCIS line is usually a waste of time, but maybe they can confirm if they got it back.
