no. u dont file i-485 every month lol

just follow the visa bulletin. uscis release it once a month. can only file for i-130 now ( after u receive ur GC) and thats it

Agreed, there's no strong correlation between medical exam and interview. In some cases yes, interview gets waived but everybody should be ready for an interview. Generally, WAVA requires a little more burden of proof from immigrant, so no surprises here.

Hi all,

 

I went on the uscis site and it has now updated our form's processing time to 39 months, up from 37.5 last month. Has anyone heard what is happening with uscis this year, I thought the processing time was supposed to speed up because they hired a whole different team (HART) to be processing the vawa forms but it just seems like the wait time keeps going higher and higher.

I half suspect that they put the estimated time on like the 95th percentile (they claim that it's the 80% mark but I don't think that's very accurate). Basically they get to tell most service request "sit down and wait" since most except the unlucky few will fall within their claimed time limit.

 

Now, I'm not exactly sure how long it takes I-360 lately since I haven't been paying close attention to it. Mine was approved back in 2020 after 27 months and I was quite the outlier.

 

On the flip side my local field office lists 17.5 months for I-485, I filed mine back in mid-June 2023 and have an interview at end of April.

 

Last part is that they recently (1-1.5 years ago?) switched systems and basically ended up adopting a last-in-first-out approach on applications. Basically whatever is in the new system gets processed fairly quickly, whatever is left behind in the old system gets worked on very slowly, the overestimate on processing times likely is meant to keep people quiet in the old slow queue.

Contradictions without citations only make you look dumb.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Good morning. 
I had my vawa process done years ago so I don’t remember somethings, maybe you guys can help me. 
I need some help for my friend. She got married 2017 but did apply for her GC until 2021 because her husband didn’t want her to be able to travel anywhere without him. They had a lot of issues during the marriage both physical and mental. In 2023 they had an interview anda couple weeks ago they received a notice for a 2nd interview. They didn’t have a lot of evidence, he never added her to bank account, didn’t let her buy a car.. he was very controlling. Maybe because of the lack of evidence immigration now wants a second interview. 
The problem is now when they received the notice for the 2nd interview the husband freaked out because according to his “friends that know about immigration” when they get a 2nd interview is because the marriage is fake and he is probably been cheated. So he got home, got into another physical altercation with her and told her he is not going to this interview and is never divorcing her either so she can forget about her green card and will never go visit her family again. 
I told her about this vawa so she went to the church that offers immigration help but they only have appointments 6 months from now and she doesn’t have money for a lawyer… her second interview is at the end of this month. Can she go to the interview alone and apply for vawa after? Can she apply now? 
any help is much appreciated, she has been through a lot!

Does she have anything proving the abuse? Did she report to police, have witness, speak to a therapist or at least go to shelter? So far she gave USCIS all the reasons to believe the marriage was for immigration benefit: little joint evidence and they crumbled when a little pressure was put on them. In my opinion she must go to the second interview with or without spouse. And she can ask for WAVA, but she must have solid proof otherwise she may get accused of fraud.

Hello Family

 

As I already shared the status of my GC after I360 approval. GC Timeline is as given below

1. March 08, 2024 => We ordered your new card.

2. March 13, 2024 => We approved your Form I-485, Application to Register Permanent Residence or Adjust Status.

3. March 23rd, 2024 => Card Was Mailed To Me. It also says in description that if you do not receive your card by April 7th, 2024, please go to www.uscis.gov/e-request to request that we send your new card to you.

 

As of today April 4th 2024 there is no update on the status. Next status should have changed to "Card was picked by Post Office" and update with the tracking no. by USPS. I don't know what to do other than waiting for it.

Any help will be appreciated.

Asking for VAWA is not something you can do. It is a petition she has to file. Also if her AOS is denied she will be put in removal proceedings.
