Hello fam, I need your advice on my long pending Vawa case, filed for I360, I765, I485 in June 2019 . See below my timeline:

 

1)  Jun 2019 - USCIS received (I360, I485, I765) form

2)  received a series of Prima Facie and have a valid one that would expire soon

3) received a series of EAD cards and renewed every 2 years

4)  Aug. 2019 - Case updated (I485) to show fingerprints were taken

5) Mar 2022 - (I360) We received your correspondence for form I360

6) Mar 2022 - (I360) We updated your name for form I360

7) Jul 2022 - (I360) Correspondence was received and USCIS is reviewing it

8.) Aug 2022 - (I131) Applied for EAD-AP combo

9)  Aug 2022 - (I131) We received your case for Application for travel document

10) April 2023 - (I131) The fingerprint relating to your form I131 was taken

11) Jun 2023 - (I360) Sent inquiry about why the case is taking longer than the processing time

12) Jun  2023 -  (I360) USCIS responded that the case not ready for decision because security checks remain pending

13) Oct. 2023 - (I131) Card approved for EAD-AP card ( 5yrs Validity)

 

It's been 4yrs 7 months waiting and Vawa has not yet been approved because of the security check pending. I need advice on the next step.

Sorry to hear that. That is unbelievable. Once it is stuck security background check there is nothing you can do but to wait. However, one thing that i would do if i were you to conduct my background check via third party and send the result to USCIS. There is someone on this forum did that in the past. You can try to do that. The cost is not much. You can google that and i would say take the chance.

WoM is the real solution. I don't think USCIS would trust security check results from any third party other the one they contact themselves.

What is the average receipt notice time you have seen here? Have you sent anything to the USCIS lately? Even on Reddit not many who are posting got receipt notices in the stipulated 30 day time frame.

 

Last year, my EAD expired in September. I sent my renewal packet in February, got a notice(after Congress person intervention) it was sent to Nebraska in June! Then got another notice it was returned to Vermont. No receipt notice from VSC till August. August, I got HRs notice requesting my renewed docs. I called and expidited-NOTHING! Thankfully, HR was kind to me and found a way to extend my authorization without the documents.

 

It was 2 weeks after my EAD expired that USCIS responded to my expedite request and issued my 5 yr EAD. NOONE cared if I lost my means of livelihood or suffered trauma from the uncertainty of the whole process. I will advice even my enemy to send early. But hey, I'm not an expert, just speaking from a recent traumatic experience.

Hi guys,

Quick story: I submitted 2019 Vawa and got approved for 2022, then I submitted I-485 to USCIS, and it is still pending. I was in the removal proceeding, and it was admin-closed. We have now submitted a motion re calander, and it was received by the court on December 1, 2023. My attorney submitted a motion and a letter (which looks like a representation letter). I just don't understand why she didn't send an approval notice. They told me, "We are just waiting for the court to schedule the final hearing or terminate it. If the court sets up a final hearing, the judge will process your application and do the "interview" in court. If the court terminates it, then USCIS will take the case back and setup an "interview" or process it without one and approve it. For now, we just wait for the court to do one of the two things. 
 

How long do I need to wait for it? I left a voice message for the judge to her clerk, but they didn’t respond at all. ( court in Philadelphia). I’m just really stressing out and nothing changing sometimes thinking my attorney did again something wrong because they already did 4 times wrong things pls give me some idea .. thank you all .

DM ME i can gove you my attorneys info, he closed my case, i was removal proceeding and he close it while my vawa is still pending

Thank you, Sandra. My children are here in the US and are below teenagers. I did not include them in the VAWA application. What do I do now that I have had my Green card for over a year now? Thank you so much.

My children are here in the US with me and they are aged 13 and 15. I did not include them in my VAWA application nor I-485.

You and your kids would be here without status if Vawa is denied. They can get deported. They can adjust their status if they get married, considering they are adults.

You will not be able to file for them until you become a citizen. Since you did not list them on your VAWA paperwork or your 1-485. You cannot file for them until then.

Sorry about your experience but giving another VJ incorrect information  does not help them either. 
 

Any petition received prior to renewal timeframe will be returned to sender.

For a second, I thought I was reading my own case. Your case is very similar as mine including dates, I have been waiting since June 2019. Its very draining, exhausting, very stressful and I don't know what else...

I have tried everything, reached out to senators, congressmen, Whitehouse, USCIS, Vermont without getting any help. I have just given up!!  My EAD based on I-485 is about to expire and I just don't know what to do!! Me too they said "Security Background check."

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
