Basically:

1. You need to be an LPR for a period of time (3 years under VAWA, 5 years under the general provision) (this is the continuous residence requirement referenced below)

2. You need to have resided in US for at least half of the time (18/36 months or 30/60 months)

3. Trips under 6 months do not break the continuous residence requirement

4. Trips over 6 months but under 12 months may break continuous residence requirement. Basically then it's up to you that you didn't intent to break it and still maintain a job, home, etc in US, or family members stayed in US. If you can rebuff it your naturalization eligibility date stays the same, if you cannot rebuff it then your naturalization eligibility date slides back 6 months.

5. Trips over 12 months do break continuous residence and then you have two options:

a. Try to file 2 years 1 day after return (VAWA) or 4 years and 1 day after return and then try to rebuff the break since the absent period in scope is over 6 months and under 12 months so basically the same requirements as in point 4 apply.

b. Wait 2 years and 6 months (VAWA) or 4 years 6 months after return to file.

 

tl;dr: Be in US for at least half the time and don't take trips over 6 months if you want to naturalize fast. Disclose trips after filing N-400 at the interview.

It's a bit more complicated than that. It doesn't protect you on its own, but in absence of other options you can make a request for deferred action.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think you should make an appointment to your local field office to get the update. That something i did. 

End of March to get my notice of receipt for the EAD renewal ?? They received it on Feb 3. What should I do if I don’t get anything from then after 3/31?

Then contact your congress person. I happened to me back in 2021 when i did not get mine receipts after over 60 days i contacted my congress person and i was able to get it.

Just did that and reached out to my state’s Senator… I spoke with USCIS and they said it is not reflected in the system. Meaning either no one has uploaded the paper filing into the system or they had lost it and I need to refile…

 

I also emailed lockbox support email…. ####### this is gross incompetence at its finest

Same thing with me when i called they said there is no info in the system. However my congressperson as able to get me the receipts. Just don't refile yet wait for the outcome of your congressperson or senator.

Thank you! Needed to hear that. I asked in a number of different forums and it looks like there are a lot of people who filed EAD renewals at Nebraska early this year (like Jan 2025) who still have not received their notices of receipts … that is ridiculous

I still haven’t received another receipt . Literally sent 2 days apart and look it takes forever now ( maybe it’s just Nebraska office )

Hey hey everyone!

It has been over 3 years since I've got my green card thru VAWA and it is time to apply for my citizenship.

I have a few questions, the application does not ask me for proof of filing TAXES, proof of VAWA case, proof that i was in abusive relationship.... It doesn't ask me much honestly... Do I just go with the flow, or should I add any document to the "additional evidence" section?

Has anyone apply for citizenship over here?
