Dear friends, I have a question that I am really confused about. I received my Green Card based on Vawa in June 2023. It expires in 2033. The resident since date is Oct 2014. My case was old and on top of that I was married to a CU6 LPR Cuban so according to the Cuban Adjustment Act my Resident date was rolled back.  

 

Since my resident since date is from 2014 and I have been living in USA continuously since 2015 Am I eligible to apply for Citizenship? Is the time to apply for US Citizenship starts from the Resident since date on the Green Card or it Starts from the date you physically receive the card in the mail? 

 

My timeline is attached. 

 

I have been a active member here while my stressful process of Vawa was in progress.

Effective Date of Permanent Residence

A person is generally considered an LPR at the time USCIS approves the applicant’s adjustment application or at the time the applicant is admitted into the United States with an immigrant visa.[9] Most applicants applying for adjustment of status become LPRs on the date USCIS approves the application.[10]

For certain classifications, however, the effective date of becoming an LPR may be a date that is earlier than the actual approval of the status (commonly referred to as a “rollback” date). For example:

  • A noncitizen admitted under the Cuban Adjustment Act (CAA) is generally an LPR as of the date of his or her last arrival and admission into the United States or 30 months before the filing of the adjustment application, whichever is later.[11]

Hello Family,

I submitted my application to USCIS VAWA center for advance parole and work authorization together in March 2024.

In April 2024, I received a receipt for the advance parole application, but I have not received a receipt for the work authorization application since then.

Could you please provide any advice on what steps I can take to address this issue?

Thank you for your input. Just to add some info here — they already know about this. It’s written on my statement the whole story. I’m not sure for naturalization and green card but for VAWA, as far as I know, bigamy is considered. But anyways, I would like to annul but if it’s going to cause problems or difficulties for my naturalization I would just file a divorce instead.

Since UICIS received my Medical Exam on April, the status did not change anything else than “ready for schedule an interview”

I filed my outside normal processing time based on i290b. The online status showed like yours and USCIS sent me an email that I should expect a decision on my case within 3 months. That if I don’t receive a decision in 3 months I must contact the USCIS number again . Hope you received a decision
