Hey family. Should I file a mandamus or not?

I485 denied and file i290b motion to reconsider April 2023. Received RFE for i601 waiver since 2023 and responded RFE July 2023. Inquired in November 2024 through a senator, USCIS responded to senator «  case pending, allow at least 180 days ». I want to remarry in September 2025, my concern is that if I  remarry that may affect my pending I601 waiver and subsequently my i i485

Your I-360 was approved, then you won't have any problem with your I-485 and waiver,  if you get married before their decision.

It might actually make the case easier if you can claim extreme hardship on the I-601 for the waiver to yourself (as a VAWA self-petitioner) and the new spouse (assuming the spouse is a USC/LPR) by amending the I-601.

 

Like you've got a case that's somehow even more messy than mine was, but strictly speaking, nothing prevents you from remarrying at this point.

 

 

So you know, weight your options, if there's no hardship to squeeze out of the new spouse or you (or your lawyer) feel confident that it could be approved if anyone bothered to look at it then yeah give the mandamus a try. Otherwise maybe just sit on it and amend it later.

Thank you, my new spouse is a USC. And she really makes good money, that’s my fear that it may work against my i601 hardship I filed. Yes i360 was approved in 2022. Yes I got a misrepresentation fraud on my i130, after filing i360 I got a notice of intent to deny because of that fraud. I submitted a bunch of proofs and i360 was approved 3 weeks after they received my RFE response . My lawyer concer was that my income combined to my new spouse income can work against my i601 hardship. She advised me to wait and remarry after a decision is made on my i485/i601

A blonde called 9-1-1 to report that her car had been broken into.  She was hysterical as she explained her situation to the dispatcher.

 

"They've stolen the dashboard, the steering wheel, the brake pedal, and even the accelerator!" she cried.

 

The 9-1-1 dispatcher said, "Stay calm.  An officer is on the way.  He will be there in two minutes."

 

However, before the police got to the crime scene, the 9-1-1 dispatcher's telephone rang a second time.  It was the same blonde.

 

"Never mind," giggled the blonde.  "I got in the back seat by mistake."

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
