Hi friends, I hope you are all well. I have my Vawa pending; Nov 27 an RFE was issued, never received the letter so I asked the Senator to request a copy, it’s been a week now and I’m still waiting anxiously. On the app, it says that there is a deadline to respond and I’m afraid with the holidays and that delay, I’ll miss it. Do you guys know how long usually is the deadline to respond RFE? I’m pretty sure they won’t extend it right and, what are my options?

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi everyone 

 

I have a question regarding the 2 years 9 months period to submit N400

 

do we have to stay in the US without visiting home the whole period of 2 years 9 months? Or is it ok if we visit? 
 

also if I choose to travel abroad to visit family for like a month, will this make the period 3 years till I submit N400? I mean the difference is only 3 months, I’m not sure if that’s worth not visiting my familY for 2 years 9 months.

 

 

Please someone explain because I keep hearing different information. Someone said if I ever visit my family abroad, even for a week, I won’t be able to apply in 2 years 9 months.

You need to meet several requirements.

 

1) Don't have any trips outside of the US lasting 6+ months in the last 3 years

2) Live in the USCIS jurisdiction for 90+ days immediately prior to filing

3) You need to spend at least 18 months in the US in the last 3 years

4) For ordinary marriage cases (no VAWA), you need to be married for 3+ years living in marital union at the time of filing

5) You should have filed all necessary taxes in the last 3 years

6) You should have good moral character in the last 3 years

This might not be the right group to ask this questions,  we got our green cards 6months ago through vawa but my child greencard had name error , we file for correction, still pending other benefits like EAD and travel document have been canceled when we got approved but now my child doesn't have anything to show that he is legal except for the copy of the greencard with name error. I dont know how true its is,that starting from January ICE will be picking up kids with no document  from schools.  Someone forwarded the news to my inbox this morning and that got me thinking what I can do pending the time we get the correct card. 

Book an InfoPass appointment to obtain an ADIT stamp. I find it hard to believe they would go to schools for this, targeting children in schools for deportation seems unlikely.It just doesn’t seem plausible to me at al

Short trips, like vacations or business travel, are generally permitted. Immigration law specifies that absences exceeding six months but under one year may be problematic. An absence of more than 180 days but less than 365 days could disrupt continuous residence.This applies during the statutory period, where maintaining residence is essential.Such absences are presumed to break the continuity of residence.

Hello Everyone, 

I have a question with my i485. I filed for Vawa back in 2018 (NYC) , my vawa approved in 2020 and then there was no updates at all on my I485 till yesterday. I received an update online that my i485 was sent to a new jurisdiction ( I guess NBC) and then another notice again new jurisdiction ( assuming local office)- nothing in the mail yet. If anyone recently had something similar , what does that mean if the case was sent into another office ?do you know how long it may possibly take to get an interview and rfe in nyc ? All responses highly appreciated.

Did you move addresses since filing I-485?
