08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

also

(c)(10) Abused spouses and children of a lawful permanent resident or U.S. citizen applying for cancellation of removal and adjustment of status under INA section 240A(b)(2);

(c)(14) Deferred action if filed by a Violence Against Women Act (VAWA) Form I-360 self-petitioner (including derivatives);

(c)(31) Principal beneficiaries or derivative children of an approved Violence Against Women Act (VAWA) self-petition; or

 

All of these are listed as having online and paper filing fees of $0.

 

(c)(9) is the normal one (pending I-485 based on pending or approved I-360).

(c)(10) is cancellation of removal (pending EOIR-42B).

(c)(14) is deferred action from a prima facie determination (in event you can't file I-485 for some reason like final order and you need the I-360 approval to reopen/terminate).

(c)(31) is approved I-360.

 

Those are all the categories a VAWA self-petitioner and children thereof can generally get an EAD under and they're all free, initial, renewal, and even replacements.

THE FARMER AND THE PIG FOOD

 

A government man approached a pig farmer and asked him what he was feeding his pigs.

 

The farmer answered, "Oh, the pigs?  I just feed them whatever scraps I have lying around."

 

The government man said, "Sir, that is animal cruelty!  I'll have to fine you $10,000!"

 

The next day, another official approached the farmer and asked him what he fed his pigs.

 

The farmer replied, "Oh, the pigs?  Only the finest products, sir!  Caviar, artisanal cheeses, and hand-picked organic salads!"

 

The government man said, "Sir, that food is way too rich for them -- they'll get sick!  I'll have to fine you $10,000!"

A blonde wife came home from her first day commuting into the city.  Her husband noticed she was looking a little frazzled and asked, "Honey, are you feeling all right?"

 

"Not really," she said.  "I'm nauseated from sitting backward on the train."

 

"Poor dear," her husband said.  "Why didn't you ask the person sitting across from you to switch seats for a while?"

 

"I couldn't," she replied.  "There was no one there."

I asked my butcher, "How do you prepare your turkeys for Thanksgiving?"

In the supermarket, I had trouble finding a Thanksgiving turkey large enough to feed my family.  I asked the store clerk, "Do these turkeys get any bigger?"  He said, "No, sir; they're dead."

 

Why did the turkey cross the road?  He wanted people to think that he was a chicken.

 

Why did the turkey stand on stilts?  Because nobody eats flamingoes for Thanksgiving dinner.

 

"Is that your pop-up timer, or are you just happy to see me?"

 

What did the mother turkey say to her disobedient children?

Hello my VJF, pls i need your advice and input. I am grateful for everyone in this group, our admins and our legends who uses their experience to help people like us. Family, I got my GC through vawa and just became  a citizen 2 months ago. Prior to my citizenship, i filed for my mom who is handicapped living with me on the month of July when I applied for my citizenship. Unknown to me that the lady i engaged her service is a paralegal. This woman filed i-140, i-145 and i-765. 2 months later she got biometric notification and we went, 3 weeks afterwards she got her work authorization. Only for me to realize she did not file for i-131 and contacted her cos we need to travel home for her sister's burial on February 2025. That was when she told me she filed i-140 because i wasn't a citizen yet at July. So I told her but she was the one that said I can put the paper work in and once I naturalize we can call uscis to upgrade it besides she she shouldn't have filed it than sending the wrong primary application which is i-140. So i changed address to stop her from accessing my mom's application. 

 

Now, what should I do family ? should I send in a new i-130 and 1-131 cos my 62 years old with 2 strokes is so depressed on hearing her sister's death informing me the only way she can at peace is to attend her funeral and pay her last respect. I don't want her to hurt herself or stroke again due to her blood pressure too. Now am in dilemma. Pls kindly advise me. Thanks all

1. new adjustment packet w all new I-130/I-485/I-765/I-131/i-864 and new medical. Pay attention there are fees for I-131 and I-765. You can include request to expedite the AP at initial filing..but follow up.

 

2. As soon as you get receipt notices ( case numbers ) you can attempt to expedite I-131 again by calling USCIS .

 

3. I don’t see chances of making it in time for February…BUT you must file at least a new I-130/I-485 /I-864 w new medical ASAP to protect mom..she is at risk w new administration.

 

4. Once new adj is filled and accepted, mom writes letter to withdraw 1st I-485 and you write in to withdraw 1st I-130 . Say it was filed in error as your Naturalization had not been completed 


5. Go slow, pay attention to everything as you are mixing up form numbers…and you CANNOT afford any more mistakes

@Family, thank you so much for your response. She filed i-140 honestly, people are mean my friend  that's why I was wondering why cos that is not related to family based adjustment. She filed I-140, I485 and I-765. Thats why they gave her the work authorization. So can I just use the 485 already applied so the cost wont be too much on me. Meaning applying for just i-131 and i-130 ?

Absolutely not. She needs to file ALL new adjustment packet as I spelled out for you. 


‘Even if that paralegal is your friend or from your home country…she did not do you any favors….and anything she tries to talk you into believing about the work permit is pure BS. ..


You should also do a free online FOIA for moms file to see what on earth that woman did. …and what fake I-140 “employer “ was used.
