Dear friends, I have a question that I am really confused about. I received my Green Card based on Vawa in June 2023. It expires in 2033. The resident since date is Oct 2014. My case was old and on top of that I was married to a CU6 LPR Cuban so according to the Cuban Adjustment Act my Resident date was rolled back.

Since my resident since date is from 2014 and I have been living in USA continuously since 2015 Am I eligible to apply for Citizenship? Is the time to apply for US Citizenship starts from the Resident since date on the Green Card or it Starts from the date you physically receive the card in the mail?

My timeline is attached.

I have been a active member here while my stressful process of Vawa was in progress.

Thanks

Hey Assalam I remember you. You are eligible for naturalization after 2 years and 9 month after your GC based on Vawa

Why the naturalization will be issue if the case is approved Ie VAWA and moreover the marriage is terminated on bigamy and the VAWA is approved

if the marriage is terminated means annulled, you are not eligible for VAWA case. If marriage got annulled after vawa, they might reconsider open your vawa case. Anyone, please confirm if I am wrong?

Hello everyone,

I have been a silent reader from 2020 and My VAWA was just Approved on July 22, 2024. I filed concurrently: i360, i485, i765, and i131.

I got my 5 year work and travel permit C09 back in March 2024 and travel to my home country and back without any issue. Seeing that my Vawa was approved in July, I got a 2 year work permit C31.

QUESTION 1: Seeing that my VAWA is now approved and I got a 2 year work permit, am I able to still use the C09 permit for traveling purposes? Or will it become invalid because of the Vawa approval?

QUESTION 2:, I am in NY, any idea how long it will take for them to transfer my case to my local office and how long it will take for them to process it?

QUESTION 3: Am I still required to do an interview? How long will I be waiting before the interview or before I get my GC?

Thank you for answering and I pray that God will open a Great door for his people to walk out of their immigration crisis with the victory!

You can get interviewed or it can get waived. GC will probably take about a year from I-485 filing date.

Did you file I-131 and I-765 with your AOS?

yes you can use your C09 EAD/Ap. It is still valid.

NY is taking somewhere 8 to 12 months to call for interview or make a decision. I would say wait 6 months, if you do not hear anything within that time frame then make a info pass appointment.

1. Yeah it remains valid. Nothing prevents you from holding multiple EAD categories at the same time.

2. Probably a few weeks for it to work its way out of VSC into NBC and then to the field office.

3. Depends. VAWA cases tend to get waived interviews though it depends, for example if you entered without inspection they will most likely interview you.

Contradictions without citations only make you look dumb.

THE FLORIST'S MIX-UP

A new business was opening, and one of the owner's friends wanted to send flowers for the occasion.  The flowers arrived at the new business site and the owner read the card, which said, "Rest in Peace."

The owner was angry and called the florist to complain. The florist replied, "Sir, I'm really sorry for the mistake, but rather than getting angry, you should imagine this -- somewhere, a funeral is taking place today, and they have flowers with a note saying, "Congratulations on your new location!"

Hi all! I got my VAWA approved after filing mandamus writ. I have been scheduled for an interview for my I-485. I’m a bit nervous as I’ve never done any interviews with USCIS before.

What questions would I possibly be asked please?

Hello family,

I just received my passport today and when I checked the visa it says “Upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year”

I thought VAWA get a 10 year GC! is this just the validity of the visa itself, or is this gonna be the validity of my green card ?

Thank you so much. I used a lawyer for my mandamus writ. I started filing and serving in May and got my VAWA approved in June. PD for i360 is 02/18/2020. We served DHS, DOJ, USCIS and the district attorney. I485 interview scheduled for August.

Neither.

The visa is valid for the first entry until the expiration date printed on it (so if it says lets say Expiration Date: 2/12/2025 you have to enter US on the immigrant visa on or before 2/12/25).

Your green card will be issued for 10 years.

LPR status doesn't expire.

After the first entry they'll stamp it and the now used immigrant visa + endorsement stamp is a temporary 1 year proof of LPR status. During that year you can use the stamped immigrant visa in place of a green card for stuff like getting a SSN, working, international travel, etc. This is just gap coverage so you have proof that you're an LPR between entry and when your physical green card is printed and mailed to you.

Contradictions without citations only make you look dumb.
