Dear friends, I have a question that I am really confused about. I received my Green Card based on Vawa in June 2023. It expires in 2033. The resident since date is Oct 2014. My case was old and on top of that I was married to a CU6 LPR Cuban so according to the Cuban Adjustment Act my Resident date was rolled back.

Since my resident since date is from 2014 and I have been living in USA continuously since 2015 Am I eligible to apply for Citizenship? Is the time to apply for US Citizenship starts from the Resident since date on the Green Card or it Starts from the date you physically receive the card in the mail?

My timeline is attached.

I have been a active member here while my stressful process of Vawa was in progress.

Thanks

That’s an interesting question . Looks like you can apply now.

https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-2

Effective Date of Permanent Residence

A person is generally considered an LPR at the time USCIS approves the applicant’s adjustment application or at the time the applicant is admitted into the United States with an immigrant visa.[9] Most applicants applying for adjustment of status become LPRs on the date USCIS approves the application.[10]

For certain classifications, however, the effective date of becoming an LPR may be a date that is earlier than the actual approval of the status (commonly referred to as a “rollback” date). For example:

  • A noncitizen admitted under the Cuban Adjustment Act (CAA) is generally an LPR as of the date of his or her last arrival and admission into the United States or 30 months before the filing of the adjustment application, whichever is later.[11]

Hello Family,

I submitted my application to USCIS VAWA center for advance parole and work authorization together in March 2024.

In April 2024, I received a receipt for the advance parole application, but I have not received a receipt for the work authorization application since then.

Could you please provide any advice on what steps I can take to address this issue?

Thank you for your assistance.

At the same time, whether @kenyy10 files for annulment or not, GC is in danger. I'd think 100 times before proceeding with N-400 in the future. I'd even think now whether to continue keeping GC. If USCIS catches up to this situation, they can rescind @kenyy10 LPR status...

Thank you for your input. Just to add some info here — they already know about this. It’s written on my statement the whole story. I’m not sure for naturalization and green card but for VAWA, as far as I know, bigamy is considered. But anyways, I would like to annul but if it’s going to cause problems or difficulties for my naturalization I would just file a divorce instead.

Strings of recent successes have validated the worth* of our jokes.

*that is, if correlation = causation

It's Sunday, so here now is our Official Weekly VAWA-Thread Joke:

=====================================================

THIS IS WHY WE LOVE LAWYERS

A Mafia Godfather learned that his bookkeeper had cheated him out of $10 million.

His bookkeeper was deaf --  the reason that he got the job in the first place.  It was assumed that he would hear nothing and would never be able to testify against the Godfather in court.

When the Godfather confronted the bookkeeper about the missing $10 million, the bookkeeper called his lawyer, who knew sign language.

The Godfather told the lawyer, "Ask him where the money is!"

The lawyer, using sign language, asked the bookkeeper where the money was.  The bookkeeper signed back, "I don't know what you're talking about."

The lawyer told the Godfather, "He says he doesn't know what you're talking about."

The Godfather pulled out a pistol, put it to the bookkeeper's head, and said, "Ask him again.  Say to him that if he doesn't tell me, I'll kill him!"

The lawyer signed to the bookkeeper, "He'll kill you if you don't tell him."

The bookkeeper trembled and signed back, "OK!  You win!  The money is in a brown suitcase, buried behind the shed at my cousin Bruno's house!"

The Godfather asked the lawyer, "What did he say?"

The lawyer replied, "He says that you don't have the guts to pull the trigger!"

Honestly, to play it safe I'd just file for divorce. Annulment based on bigamy should be fine, annulment based on any other factors likely would not.

Hi everyone,

I submitted an inquiry on my i485 case, and they completed review it, I would like to ask how to know the result/response for that inquiry?

Since UICIS received my Medical Exam on April, the status did not change anything else than “ready for schedule an interview”

IMG_1457.jpeg

I filed my outside normal processing time based on i290b. The online status showed like yours and USCIS sent me an email that I should expect a decision on my case within 3 months. That if I don’t receive a decision in 3 months I must contact the USCIS number again . Hope you received a decision

Because our Official Weekly Sunday VAWA-Thread Joke worked so well, here's our Semiofficial Semiweekly Wednesday VAWA-Thread Joke:

=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=

AFFIRMATIONS

Grant me the serenity to accept the things I cannot change, the courage to change the things I cannot accept, and the wisdom to hide the bodies of those people I had to kill today because they ticked me off.

And also, help me to be careful of the toes I step on today, because they may be connected to the butt that I may kiss tomorrow.

Help me to always give 100% at work... 12% on Monday, 23% on Tuesday, 40% on Wednesday, 20% on Thursday, and 5% on Friday.

And, help me to remember... when I'm having a really bad day, and it seems that people are trying to tick me off, that it takes 42 muscles to frown and only four to extend a certain finger and tell them to bite me.
