10 months in different state with no clear timeline of coming back to address in Florida. There's nothing more permanent than temporary in this world. I cannot agree with recommendation to use Florida address. @Roms2019 is probably a tax resident of Texas by now with over 183 days living there. IMHO it's an easy denial by USCIS saying the applicant didn't reside in the state in the last 90 days...

Hi olduser,

- In this case i can still submit change of address since i already spent 10 months in texas?

then file for my N400 using Texas address?

- 2nd if i go back to Florida  meaning i have to wait 3 months before i file N400?

Please give me your point of vue which one is better to avoid any trouble.

Considering that N-400 is one of the few things where you need to be domiciled in whichever state you file from for at least 3 months right now it all depends what you plan to do.

 

If you plan to stay in TX for the foreseeable future - file with the TX address and just naturalize in TX and then you're free to move wherever. If you are going to move to FL (or any other state in the next couple of months) then move to that state, wait 3 months, and file then. Filing and moving will likely just get your N-400 denied.

 

Yeah it's annoying but if you want to file N-400 you both need to live in said state for at least 3 months and stay there until you naturalize. Sadly the 90 day early filing option applies solely to time as an LPR (3 years if married to a USC or VAWA, 5 years otherwise), it doesn't apply to the domiciled in state or USCIS district requirement.

I got my PR through vawa also.

I was just worried about change of address i didn't do since i am in Texas.

That was my biggest worried, it was about the change of address i didn't do since i am in Texas.

Your residency is where you filed your taxes. Your N400 won't be affected.

Your residency is where you filed your taxes. If your address isn't the same as what USCIS has on file, let them know.

Thank you, i was expecting to get your response also to confirm.

One lawyer told me the same about  my residency is where i file my tax, so i have filed my tax in Florida.

Without doubt this is where i will file my N-400.

I am going back to Florida next month, Now do i have to wait 90 days in Florida before i file the N-400?

A truck driver was driving along on the freeway.  A sign came up that said, "low bridge ahead."   Before the driver knew it, the bridge was right ahead of him, and he got stuck under the bridge.  Cars were backed up for miles.
