Dear freinds can someone share the experience that if I request the USCIS to obtain the citizenship certificate through FOIA about the abuser as third party will this work what is the procedure have some one able to got a success in this way.

They probably won't give you a copy of the naturalization certificate, but they will take circumstantial evidence like an I-130 receipt/approval notice, marriage certificate listing the spouse's place of birth in the US, if naturalized they will actually do a status check on your behalf where you can give them information about the ex (name, SSN, A#, place of birth, etc).

 

Like, USCIS does understand that part of the eligibility involves documents regarding a hostile third-party and they might be simply outside of your reach.

Thank you for your kind help and support. You are the best but you know like there are so many problem in USCIS system. I applied for  VAWA five years before I got approval notice of VAWA without any RFE. I got my green card without any interview but unfortunately since I’m appearing in the citizen ship interview I have encountered with is a very rude officer over there who started again asking the question and putting pressure on me to verify the status of the abuser and I told her that these things were already established then she took the citizenship test and at the end gave me a letter the civic test is pass how ever no decision was made and later send me the RFE to establish the abuser citizenship status feeling pressure

What you can try to find is his voter registration card. That is easier than submitting FOIA

Thank you for your kind help and support I already proof the status of the  abuser with social security driver license  and voter registration in VAWA process no RFE was ever issued because the VAWA unit verified the same then in the green card this fact was verified by the file office but unfortunately in the citizenship interview I encountered a really bad officer who is asking again and again about the abuser status I provided her the supporting documents but despite all these proofs she issued a RFE to prove the status of abuser and surprisingly it has only 30 days to respond feeling depression

You already have approved Vawa. They won't request for abuser immigration status during your N400 interview

Oh wow !! Sorry you had to go through with all of this. They are not supposed to request abuser immigration status since you already provided them all the evidence during your vawa.

I’m an October 2018 VAWA filer, I went to the USCIS field office on Wednesday to request Emergency Advance Parole to attend my mother's burial ceremony in my home country.

 

The officer asked for all supporting documents, including the death certificate. I informed him that I had it in my car, and he allowed me to retrieve it. After returning with the certificate, he called his supervisor. She told me they needed a second verification outside of a government ID and required me to do fingerprinting and photo capturing in the office, which she completed for me.

 

After that, I went back to the initial officer, who informed me that he would expedite the I-131 I submitted in April. He asked me to write my home address on a piece of paper.

 

Additionally, USCIS told the Congressperson in March, 2024 that my VAWA case is still in the background check stage.

 

What do you think about my VAWA and the EAP, family?

Yes you are right but if you encounter with a bad officer anything is possible

@J2020 Be sure to go through your whole case..some officers try to re-adjudicate (which is not supposed to be) but hey be prepared. Be confident, articulate and polite. Don’t forget your important documents and copies. You got this!👍

Wow! My condolences 💐 regarding the demise of your mother. Your VAWA is from 2018? Some cases for some reason just takes longer than necessary..but you still have to wait it out. Good thing the officer agreed to expedite your travel document. 
 

One would have to be an insider to determine the outcome of your pending case. Those security/background checks seem to drag on forever but hopefully yours gets resolved soon. 
 

Keep pressuring them via your congressperson. You may be able to submit anything else that can strengthen your case if you have. But probably that’s not your situation but just in case.. I wish you all the best!🙏
