That is up to the IO. Gathering your evidence takes time. It took me 6 months to gather my information before I filed. Also, she can file another AOS with her VAWA petition.

Bring an I-360 receipt notice to the interview and have them switch the I-485 over.

If she doesn't have the receipt letter instead tell them that it was filed/will be filed, and to hold the I-485 in abeyance and she'll get them the I-360 ASAP. Then mail in a copy to the field office that did the interview.

 

This is what's known as transfer for underlying basis, I-485 doesn't get denied, it just gets moved from one petition to the other and USCIS won't place someone with a pending I-485 into removal proceedings.

 

On the bright side one does not have to pay another filing fee for I-485 while doing so. On the other side, obviously nothing can be done about the I-485 until the I-360 is approved, so the I-485 will get sent to Vermont or Nebraska and sit there until I-360 is approved.

Hello Family

 

As I already shared the status of my GC after I360 approval. GC Timeline is as given below

1. March 08, 2024 => We ordered your new card.

2. March 13, 2024 => We approved your Form I-485, Application to Register Permanent Residence or Adjust Status.

3. March 23rd, 2024 => Card Was Mailed To Me.

But after that there is no update from USCIS. The current status is given below.

On March 23, 2024, we mailed your new card for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number ABC1234567810, to the address you gave us. If you do not receive your card by April 7, 2024, please go to www.uscis.gov/e-request to request that we send your new card to you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

 

As of today April 8th, 2024, I did not receive my Green Card and there is no update on the status.

 

What should I do? Should I ask my attorney to submit the request or I can submit the request by myself? how long it will take after submitting the request?

Was the card to be sent to your attorney, or to you?

If to the attorney, contact his office and ask them to look around to see if it's there.

If not, maybe wait for one week, if you can stand it.

If your attorney won't charge you to make the request on your behalf, he can do it.

Otherwise, you're free to submit the request.

1. Card was supposed to go to my attorney but she didn’t receive it yet.

2. Case status didn’t update with usps tracking information.

3. Already called my attorney today and asked her to check if she has received it or not.

4. If not I will ask my attorney to submit e-request with Uscis for them to send new card.

Hi everyone! Anyone familiar with vawa after obtaining green card ? I am a green card holder through vawa. I obtained it in 2021 and i am already divorced. I am eligible for citizenship now because it has been 3 years. My question is, if i get married will I still be eligible for citizenship this year or the 3 year rule does not apply anymore once you get remarry? I have heard people say that if you remarry before obtaining your citizenship through vawa, you have to wait two more years to be eligible. Please advise. Thanks

Hello Family, I’m October 2018 filler and no approval yet but I just contacted my congresswoman today and I’ve completed some forms for her to request case update from USCIS on my behalf.

 

I want to renew my advance parole and work authorization Card.

 

My advance parole paper expired today (4/10/2023 to 4/9/2024) but the stamp on my passport says June 9, 2024. Which date I should follow?

 

I approached my attorney regarding the renewal process, and she informed me that there will be an attorney fees involved. Unfortunately, I am currently unable to cover these costs. Therefore, I am exploring the possibility of filing the renewal applications myself.

 

Please I need help for guidance on the required forms and procedures for renewing both my advance parole and work authorization Card.

 

Any assistance or advice in this matter would be greatly appreciated. Thank.

Just ignore the stamp on your passport. Your AP expired today and that's the correct date. Do not travel unless you get the new AP documents. 

AP/EAD are the simplest form to fill. Just do it your self.

Thanks for the info. Can I expedite the process because I need to travel by June 25 ?
