Well here's the thing - USCIS will upon a denial of I-751 place you into removal proceedings. Immigration judge can review the I-751 de novo and can approve it, alternatively you can in fact file I-360 if you're still within the filing window (within 2 years of termination of marriage), file I-485 with the court and re-adjust.

Sometimes they don't and you basically have to request it from them...

I'm thinking of withdrawing pending i-751 since my i-360  has been approved. And when I come back to the U.S I just file I485. ( I just don't know how much time I have).I am not sure if Even should, because when i751 is pending, my I551 stamp in passport says that I'm a conditional permanent resident since 2016. It's complicated.

So you file i-360 because you have a conditional green card?? I think you should come back to the US as soon as possible.

I don't think I-360 can be used for reentry into the US

But if she withdraws I-751, I'd think extension letter is void? Though she has a I-551 stamp. Yeah it's a mess and a law exam question...

I am not sure what to do...I will talk to the attorney... yes, the lawyer filed BOTH I-360 and I-751 and one was denied another one approved...the second i751 is still pending and I have a valid stamp...

Hi,

For VAWA is I-485 adjudicated without divorce? We are separated and I do not know his whereabout to file for divorce and I-360 is still pending.

Yes. My lawyer said you can get a green card if you still married your abuser

You withdraw I751, you no longer have a GC. You will not be able to return to the US.
