If he knows about VW and he did not abuse you  in any way , i believe is better to drop out your application before uscis finds out and send you to court for fraud. If he did abuse you and you have an strong case keep all records and keep going with the case.

I've overstaid my visa and my family is helping me make a case for psychological and mental abuse.

 

I've been visiting a therapist after our separation. 

 

If I leave the country it will be hard for me to come back because I'm nearing the 6 month overstay mark past my visa

It will still sounds like a fraud for uscis.

My ex has evidence of me trying to ask for a legal marriage before wedding, so I could overstay 

So what is the case then? If it's all fradulent, you can withdraw WAVA, pack things and depart the US at first convenience. I doubt anybody on this forum will be supporting a case involving fraudulent marriage.
