Bringing stepchild to US, petitioner is USC

Hi there, yall have helped me greatly on my decision on K1 or CR1 visa.

 

Now, I would like to enquire a little further for my son.(I'm the mother and the foreign spouse).

My future husband is a USC, we are getting married before my son turns 18 years old.

 

Unfortunately, my son being a Singaporean, needs to serve his mandatory National Service for 2 years(this will be at 18 years old) before he can migrate. And for him, he may only renounce Singaporean citizenship upon reaching 21 years old.

 

I understand we will need to file another i130 for my son. Will this has to be before he turns 21? Should his petition I130 be approved, is he able to leave US for 2 years to complete his National Service in Singapore?

 

I was looking at the CSPA and am unsure about this. 

 

As my plan would be for him to remain in Singapore and complete his National Service and while awaiting for his National Service to be completed, we could file the petition for him and if it is approved, we could bring him over to US.

How does it goes if he has to leave US while having a green card for 2 years?

If he is a green card holder and has to leave the U.S. for two years, he can apply for a re-entry permit prior to leaving.

Husband files I-130 for the stepson (marriage HAS to occur before son turns 18!) and then you just slow walk NVC part so he can interview after he's done with the military service.

No, but given the length of time needed just to get USCIS approval, I wouldn't wait too long to file.

Correct. Filing locks in the age when petitioner is a USC.

When the case gets to NVC, don’t pay any fees or upload any documents, just access the case or contact NVC at least once every 12 months to keep it in stasis.
