Vaccine waiver i601 questions [merged threads]

Hi all, 

 

I've recently received the interview date and about to go through medical exam. I know i'm going to file for the religion vaccine waiver. 

 

My question is:, Is it ok that i file the waiver before the interview gets denied, or maybe just after the medical exam when i receive the RFE from the panel surgeon, or would i have to wait until after the interview and get a RFE to then submit the I601 waiver?

What kind of visa are you applying? Are you in USA?

K1 2017

Aos sent April 2018

Aos interview July 2018

Work permit September2018

Aos approved July 24, 2019.

Roc April 27, 2021

Biometric reused june 28, 2021

N-400 online April 27, 2022 base on 3 years rule, biometric reused.

N-400 interview on December 12, 2022 combo interview i-751. Approved.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).

March 11, 2023 passport in hand

You file once you have been refused a visa and offered to file a waiver.

 

You can have the package ready to go when this happens.

Another member on the forum filed the waiver before interview. And IIRC it was approved a year later. I’ll see if I can find the post.

Hello,

 

I'm the petitioner in the process for my IR1 visa. And i'm going to apply for a religious vaccine waiver. I've got my medical exam done today. 

 

However, the civil surgeon in my country said that she has never encounter someone who is going to apply for a vaccine waiver here. Therefore, she's not sure what to do. She just leave a note stating that i will be applying for vaccine waiver later on. 

 

I'd like to ask if this is sufficient action from the civil surgeon as I also have a hard time finding someone who share the same experience in my country in any forums.

 

And would the next step be go through the interview at the consular office and also just let them know i'll be applying for a i601 vaccine waiver then submit that to the USCIS?

Seeing that your timeline is unecessarily blank, I am going to go by what you have said in your post (that you (since YOU went to the medical) are a CR1 visa APPLICANT and not a US petitioner) and have moved your post to the appropriate CR1 VISA forum as you've incorrectly posted it in the K visa AOS forum. You're likely to receive more help over there.

Your situation is quite rare though so you may need to direct your enquiry to the I601 forum instead. Let us know.

You will go to the interview.

 

The IO will refuse your visa as you have an incomplete medical.

 

You will be given the opportunity of filing a waiver, the I 601.

 

Do you have a Lawyer, most people maybe be able to do a regular case but not put together a waiver package.

Here is the timeline for a vaccine waiver based on religion for an AOS applicant.

 

You will have to submit the documentation after the interview but you can start compiling your evidence and your letter now. 

Reach out to religious leaders and friends to write affidavits for you. 

If you think you are a good writer you can submit the waiver yourself. Or you might want to hire a lawyer to help you with the package.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
