1. Let go of missing coversheet . .all that was needed was to include a copy of RFE with response.

 

2. If you were betting on international delivery to be a sure shot…it was a risky move….courier error notwithstanding 

 

3. Believe or not, since RFE was addressed to the USC Petitioner, they really did mean to get a response from her…they will be scratching  their head if you signed your name to the response . But they’ll take it

 

4. ACTION PLAN. USC wife writes a very short statement Timely Response to RFE hijacked / bogged down ( pick a word) in International Couriers Great Mistake.
‘Please accept this earnest 2nd joint effort along with evidence of duly sent prior timely response .

UPLOAD from wife’s computer to her USCIS account . 
 

IF there is a denial, you will win on I-290 B

hello

 

as mentioned above this post is revolves around an error from the USCIS which resulted in the refusal of my green card application ..sometime ago i had recieved an RFE . i am the beneficiary living outside of USA. i arranged some evidences of a bonafide marriage to address the RFE. i had the package sent from my home country well 2 weeks before the deadline but the package did not reach the destination.. upon inquiring i learned that the USCIS failed to include the necessary barcode page at the end of the RFE that resulted in the delay..since the courier companies did not find that page that contained the barcode , the package kept sitting in a kind of limbo at the courier offices..it was only after the deadline had passed that i learned of this issue but unfortunately it was too late by then and the USCIS had already refused my application. 

 

this was a brief history of the issue. my wife has written to the concerned officer about the blunder that they had made. we kept waiting for the response but they only sent a confirmation email after 2 months simply acknowleding the receipt of the mail and also stating that they will be looking into the matter.  in light of this information i wish to ask that WHAT ARE THE CHANCES THAT MY CASE WOULD BE REOPNED. ?DO THEY EVEN CONSIDER SUCH TYPE OF REQUESTS.?? IF NOT THEN HOW SHOULD WE PROCEDD WITH THE ISSUE GIVEN THAT FACT THAT IT WAS NOT OUR MISTAKE AT ALL... i have attached alll the proofs that my package was in the USA well within the deadline and it was only due to the lack of the address that resulted in the delay...what are the chances of getting the case reopened...THANKS

I have never heard of USCIS sending a delivery label with a bar code used by couriers.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Doubt it would be reopened. Have your wife prepare a new I-130.
