She only got her visa approval last week and we're still waiting for the passport with the stamp. So according to the above as long as she never entered the US on her visa he's ok to go with her?

That is why I was asking if the visa status online was saying "Issued", but in this case the child appears to have been born prior to the issuance of the visa which means the above links do not seem to apply.  I guess you need to get an I130 in the system ASAP and request expedites at each stage.

 

Apologies for misleading you, and it is really frustrating that the consulate will not do a DCF for the child given the soon to be immediate need to travel.

Do you have an idea?

I would submit evidence relating to child needing to be in the care of his mother. maybe a doctors note attesting to the fact? Also, a letter explaining the situation. Along with birth certificate.

This is baby is less than 2 months also, isn't that a reason to expedite?

If you are expected to start employment upon entering the US, that may be evidence of a financial loss that can be included.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This is why I mentioned maybe having a letter from a doctor talking about the child needing their mother (because they are not yet 2 months old). 
Letter explaining the situation: child is not yet 2 months old, one could not submit an I130 for a child who is not yet born etc etc long wait for interview from embassy means the child will be 2-3 years old before they will be able to move to the US… I’m not sure how long the time between submitting the I130 to interview for your wife was but I would include her timeline to explain why your child’s I130 should be expedited.

Ok, I will call the doctor tomorrow asking for this.
