Evidence for an expedite request for a new baby.

I never thought it would come to this but I guess here we are. My wife and I just welcomed our first son, coincidentally receiving her invitation to attend the embassy interview on the same day.. talk about luck. We understand that we need to apply for an IR2 visa for our son to accompany her, and we're considering requesting an expedited process to make sure that both visas are issued at the same time (if possible). Fyi I'm the USC but I don't have the full 5 years to apply for the CRBA for him. I have a few questions and was hoping to get some guidance.

  • Is the IR2 visa application just a standard I-130?
  • How can we request an expedition for this process?
  • Do we have to request an expedition during the NVC stage as well?
  • Apart from showing proof that he's my son and obtaining a passport for him, what additional documents are required for his visa application?
  • Considering the timeline of 2 months until the embassy interview, is it feasible to complete all necessary steps in this timeframe?
  • Would it be advisable for my wife to proceed with her interview while our son's application is under review, and we wait until his visa is issued before making travel arrangements?
  • Any other suggestion you folks may have for us?

I will correct myself here but I won't delete my original response in case the info is useful for other people.

 

I completely misunderstood your situation, looks like your wife does not have her visa yet and your child was already born.

 

To answer your question, if you are completely sure that your child does not qualify for a CRBA then the best option will be to file for IR2 (the regular i130 form) and try to expedite it, someone with more experience can guide you regarding this in case is possible to expedite.

Does your wife already has her immigrant visa with her? Physically? If so, was the visa issued the same, before or after the child was born? I believe If the visa was issued before the child was born then you should be able to bring your wife and your kid, the infant can travel without a visa. Just make sure to bring your child birth certificate at the port of entry here in the US. 

 

Also, I don't think the interview date is important, what matters is the date of the visa was issued, sometimes or many times the visas are issued days after the actual interview date.

I would immediately contact the consulate and ask them to process the I-130, and schedule both interviews together.  They have the discretion to directly process the child's I-130 rather than going through USCIS.  They can then reschedule wife's interview together with child's interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If it's an Embassy it's an Embassy. If it's a Consulate it's a Consulate....BUT....If you want to always be right, Immigrant Visa Units are part of Consular Services.  In many countries the IV unit is not only not in the Capital City but also not at the same location as the actual Consulate.  Here are some examples.  Guangzhou, Cuidad Juarez, Montreal, Frankfurt, Mumbai and on and on.  Visa interviews are conducted by "Consular Officers".

Yes, but if the consulate accepts it, they will process the I-130 directly.

The I-130 instructions tell you what to include for a child.  Note, this child will never have a green card.  Becomes a citizen upon arrival in your custody.
