Under 21 filling and COVID requirements

Timeline

I filled I-130 for my child (under 21) who is living in Europe. During the medical visit, the Dr.informed him that he needs to get an up to date COVID ax (literally COVID vax version 2024) The issue is that he had 2 shots back in 2022 and it caused him a health havoc, almost suffered a heart attack. I'm not feeling well pushing him to follow the Dr. directions. Also, during the visit,the Dr. was clear that "no vax = no visa"

When I emailed the Embassy to ask about our options because the Dr. didn't mention anything about exemption process...etc.

any input or if someone went through similar situation?

You can apply for a I-601 waiver - there’s a whole forum below about them. Adds about a year to the process I believe.

Do the waiver. 

 

Then also get in touch with your congressional representative on the idiocy of requiring COVID-19 shots known to do nothing but cause harm including death to recipients. CDC is out of its mind.

Because that would be immigration fraud. You cannot enter with a non immigrant visa with the intent to adjust status.

As said above, that’s immigration fraud and could result in him being banned from the US. But he’d still need the shot, or a waiver anyway - the vaccine requirements would still apply.

I filed for my underage son a year ago, the embassy is asking for updated COV19 vaccine even if he had 2 shots previously. Long story short, if we move to AOS, do we file new I-130 or we can use the same one we filed previously?

Where is your son now? 
 

Not sure what the relevance of the Covid shots is, as he’ll need to meet the requirements however he applies. Or apply for a waiver.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Others have already explained that a person cannot enter the US as a visitor with the intent to stay and adjust status.  Per your post history, he is currently in Europe, thus, adjustment of status is not available.
