Hi community. My husband has been waiting for I130 overseas and now we are just in NVC stage.

 

I have my last 5 years tax return except for last year (2022) and NVC/Consulate is asking me to provide my tax return for last year as well (2022)

 

Last year I(US citizen) had to mail my tax return because my husband lives aboard and had no SSN.

I was told by turbotax to print my tax return and mail it to IRS and I mailed it with certified usps.

 

Its been 9 months and IRS still hasn't been processed my taxes. I have a copy of my turbotax papers but not sure if it is enough to send.

I tried to call IRS but its impossible to find someone to answer. I have official IRS returns for previous years but since they didn't process my 2022 return yet, I don't gave documentation for it.

 

What should I submit to NVC/Consulate for 2022 tax return? Do I have to wait for IRS to process my taxes? But what if they take longer?

It is. Just send everything you sent to the IRS such as schedules, W-2s, etc.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As you continue, pay attention to little words like or, and, if etc.  You missed the "or" applicable to complete copy of tax return OR tax return transcript.

Facts are cheap...knowing how to use them is precious...

thank you sir. I read that but I wasn't sure what "tax return transcript" or "copy of tax return" refer to.

So copy is tax return  = what I mail to IRS?

So it is perfectly fine to send what I mail to IRS? It is 1040 tax form + my W2s. I was thinking that they would expect to see official letters from IRS (not from me).

A complete copy of a federal tax return, is exactly "everything" you would mail to IRS if filing by mail.

  I would also go to IRS site that shows they recd return (but not yet completed it)  and print out that page to show u do not have IRS transcript and all u have is copy of what u sent

Yes.  A tax return is generated by the taxpayer....A tax transcript is generated by the IRS. Either is acceptable.

Correct but there are multiple transcripts.  The "Tax RETURN Transcript" is the only accepted one.

thank you both. i was worried that I have no proof of tax return because IRS hasn't processed yet. I'm just sending "whatever I mailed to IRS" as a proof.

 

as a result, what I mailed to IRS with my signature(Form 1040, W2, etc) == Tax Return transcript which is sufficient for USCIS/NVC/Consulate. Correct?

You have or will sign your affidavit of support under penalty of perjury.  The "or" in the instructions is there on purpose.  Trust it.

I'm trying to E-FILE this year's tax (spouse is abroad, non resident alien, with no SSN)

 

Is it okay to e-file if a tax software allows me to? or is it illegal or wrong/incorrect to e-file taxes in this situation? I don't want to mail it again so I prefer e-file but it seems like only a few software is letting people e-file without SSN.

i'm using taxAct(heard people used it without spouse's ssn)

 

i appreciate if you have any thought on this.
