Good morning,

 

I’m adjusting status from F-1 visa. I married a USC.  my EAD just got approved (Praise God). Interview has been waived. Only thing missing is respond to the RFE. I have been in school for a while (i had to switch colleges due to financial reasons which allowed me to continue my studies here in the States and follow the rules). i recently got a co-op with Mercedes which has been awesome. i transfer from a small christian school to a big state school. school has never been an issue to me, so i didnt think my new school was going to be hard. however, i have been struggling alot plus this whole immigration process has been hectic plus my husband is leaving for military duty plus working (school job). so its been a roller coaster which has made it hard for me to concentrate in school. Thanks be to God im only struggling in one class. however, i dont think ill be able to pull my grade up for i only have one month left. since i have to mantain my full time status, idk if its wise for me to terminate my f-1 status. i want to drop this class and retake it in the summer. dropping it wont affect my GPA and get to keep my scholarships. i dont want to get cocky and then something happens with my AOS.  I am planning to continue in school and graduate. I just can’t take this class right now and summer is the best choice and I don’t have the money to substitute it. so with this background, what are your recommendations?

How do you know that?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am not going to comment on what you have to do to keep in F1 status, something to discuss with the International Admissions Officer.

I already know what I have to do to keep F1 status. Have been here longer than I anticipated, I know the rules too well. I already discuss it with them.

Drop the class…keep the spouse.

Not quite clear from your very detailed post, but I am assuming here your new big university is not charging you international student tuition…so enjoy the benefits.

F1 and J1 visa holders are not eligible to domicile in the US per the US Immigration office, therefore, a student holding an F1 visa would not be eligible to apply for in-state residency for tuition purposes.

Really? And they told you this? You must be new to immigration. 

 

Your question could have been asked within the first 2 lines. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
